RESOLUTION NO. 5872
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA ESTABLISHING FEES FOR BUILDING
AND FIRE CODE APPEALS AND PROPERTY MAINTENANCE
ORDERS TO ABATE APPEALS AND AMENDING SECTION 4
OF RESOLUTION 5814 RELATING TO THE APPEAL PROCESS
TO THE HANDICAP ACCESSIBILITY APPEALS BOARD
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY RESOLVE
AND DETERMINE AS FOLLOWS:
SECTION 1. That the fees set forth in this resolution are necessary for the
purpose of defraying the City of expenditures and costs for the purposes set forth in
this resolution, and that said fees do not exceed the estimated reasonable costs for
providing the service.
SECTION 2. Pursuant to Arcadia Municipal Code Section 8040.3, there is
hereby established a Building Code Appeals fee of $500.00.
SECTION 3. Pursuant to Arcadia Municipal Code Section 3116.2, there is
hereby established a Fire Code Appeals fee of $500.00.
SECTION 4. Pursuant to Arcadia Municipal Code Section 9406.2, there is
hereby established an appeal fee for Property Maintenance Orders to Abate of $500.00.
SECTION 5. That Section 4 of Resolution No. 5814 be amended to read as
follows:
"Any person may file a written notice of appeal with the Secretary of the Board
within thirty (30) days after an action is taken by the Department regarding the
regulations pertaining to public access for handicapped persons. Before accepting for
filing any appeal. the City shall. for the purpose of defraying the expenditures
incidental to the proceedings described herein charge and collect an appeal fee in
accordance with the applicable fee schedule adopted by resolution of the City Council.
Thereafter, the Appeals Board shall set a time and place for hearing the appeal and all
persons interested shall be heard. The Secretary shall give the applicant at least ten
(10) days notice of hearing."
SECTION 6. Pursuant to Resolution No. 5814 as amended by Resolution No.
5872 there is hereby established a fee for Handicap Accessibility appeals of $500.00.
SECTION 7. The adoption of this resolution shall not in any manner be
construed as affecting any such fee, nor effect the validity of any bond or cash deposit
in lieu thereof, posted, filed or deposited therefore and all rights and obligations
thereunder appertaining shall continue in full force and effect.

SECTION 8. The City Council hereby finds that the fees specified in this
resolution will not produce an amount in excess of that estimated to fund the
operation of the City of Arcadia Development Services Department or Fire
Department. Based on the foregoing, the City Council hereby finds this resolution is
exempt from the requirements of the California Environmental Quality Act as
specified in Title 14 Section 15079.1 of the California Administrative Code.
SECTION 9. The City Clerk shall certify to the adoption of this Resolution.
