HomeMy WebLinkAbout5876 RESOLUTION NO. 5876 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, MAKING FINDINGS PURSUANT TO HEALTH AND SAFETY CODE SECTIONS 33445 AND 33679 AND AUTHORIZING THE USE OF REDEVELOPMENT AGENCY FUNDS FOR PUBLIC IMPROVEMENTS COMPRISING THE UPPER Y LANDSCAPING IMPROVEMENT PROJECT WHEREAS, the City Council (the "Council) proposes to construct landscaping improvements in the raised median at the intersection located at Colorado Place and Colorado Boulevard (the "Upper Y"); and WHEREAS, this project is located in the public right-of-way; and IJI.fHEREAS, Health and Safety Code Section 33445 requires approval of the expenditure of Redevelopment Agency funds for improvements which will be publicly owned, if after a noticed Public Hearing and preparation of a Summary Report as required by Health and Safety Code Section 33679, the City Council is able to make 3 findings: a) that the proposed improvements are of benefit to the Project Area or the immediate neighborhood in which the project is located; b) that there are no other reasonable means of financing the improvements available; and c) that the payment of Agency funds for the improvements will assist in the elimination of one or more blighting conditions inside the Project Area and is consistent with the Implementation Plan pursuant to Section 33490; and WHEREAS, the City has prepared and published in the Pasadena Star News Hometown Section (Arcadia) on August 3 and August 10, 1995, a Notice of a Public Hearing for Tuesday August 15, 1995, 7:00 p.m., in the City Council Chambers on this subject. and said Notice also informs the public of the availability of the Summary Report required by Health and Safety Code Section 33679; and WHEREAS, the report entitled .Summary Report - Upper .V" landscaping Improvement Project Pursuant to Health and Safety Code Section No. 33679" is attached hereto as Exhibit U A" ; and WHEREAS, Exhibit U A" sets forth the facts regarding the amount of property taxes to be used to pay for the proposed improvements, sets forth the facts supporting the three determinations to be made by the City Council per Health and Safety Code Section 33445, and sets forth the redevelopment purpose for which such taxes are being used: NOW, THEREFORE, THE CITY COUNCil OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOllOWS: SECTION 1. The facts set forth in the recitals are true and correct. SECTION 2. A public hearing has been held on the proposed expenditure of Redevelopment Agency property tax increment funds for public improvements. SECTION 3. The facts supporting those certain findings required by Health and Safety Code Section 33445 are true and correct as set forth in Exhibit U A", attached 2 5876 hereto and as set forth in the staff report submitted to and considered by the City Council with reference to this Resolution. SECTION 4. The City Council hereby finds that the proposed public improvements are of benefit to the Central Redevelopment Project Area, or the immediate neighborhood in which the project is located. SECTION 5. The City Council hereby finds that there are no other reasonable means of financing the proposed improvements available to the community. SECTION 6. The City Council hereby finds that the payment of funds for the proposed improvements will assist in the elimination of one or more blighting conditions inside the Central Redevelopment Project Area, and is consistent with the Implementation Plan adopted pursuant to Health and Safety Code Section 33490. SECTION 7. The City Council hereby approves and consents to the payment by the Arcadia Redevelopment Agency for all or any part of the public improvements which are part of the Upper .V" Landscaping Improvement Project. SECTION 8. The City Clerk is hereby authorized and directed to certify to the adoption of this Resolution. 3 5876 SECTION 9. This Resolution shall take effect upon adoption. ALFORD, City Clerk of the City of Arcadia hereby certify that the foregoing Resolution No. 5876 was passed and adopted by the City Council of the City of Arcadia, signed by the Mayor and attested to by the City Clerk at a regular meeting of said Council held on the 15th day of August, 1995, and that said Resolution was adopted by the following vote, to wit: AYES: Councilmember Chang, Kuhn, Ulrich,and Young NOES: None ABSENT: Councilmember Lojeski 5 5876 SUMMARY REPORT UPPER "Y" lANDSCAPING IMPROVEMENT PROJECT PURSUANT TO HEALTH AND SAFETY CODE SECTION NO. 33679 The following summary report is prepared pursuant to Health and Safety Code Section No. 33679 and serves to describe the Upper "YO Landscaping Improvement Project in the City of Arcadia. This report is necessary because Redevelopment Agency tax increment funds are intended as one of the funding sources for this public improvement project. 1. GENERAL PROJECT DESCRIPTION: The Upper "Y" Landscaping Improvement Project is a minor beautification project to take place in the public right-of-way (raised median island) at the intersection of Colorado Place and Colorado Boulevard in the City of Arcadia (See Location Map), Currently, the raised median island is an unimproved asphalt surface. This project involves removal of the asphalt surface, installation of water and electric service and improving the area with irrigated landscaping. 2. COST OF THE UPPER "Y" PROJECT (33679(a)): The total estimated cost of the Upper "Y" Landscaping Improvement Project is $31,000 (C,I.P. Detail Form attached). Of this amount, it is proposed that the Redevelopment Agency fund $18,000 with tlie balance ($13,000) funded with Gas Tax Revenue. 3. HEALTH AND SAFETY CODE SECTION 33445 FINDINGS: 33445(1 )(a) - [The Project will benefit the Project Area] This project is located within the Central Redevelopment Project Area and will provide a direct benefit to the Project Area. The Upper "Y" currently consists of an improved asphalt surface. The project will replace this surface with a landscaped planter. This planter will add color, break up the lines of site and provide some visual relief, 33445(1 )(b) - [No other reasonable means of financing the project are available] Because of the recent economic downturn and the City's ongoing priorities, there are insufficient City funds available to pay for these improvements. City funding sources considered and discarded as not feasible include the Equipment Replacement Fund, City Water Fund, and Facility Construction Fund. Competing City needs affecting the basic health, safety and 5876 Exhibit "A" welfare of the community prevent the use of additional City money from these funds. Adequate redevelopment funds have been set aside in the Agency's Project Budget to reimburse the City for the costs of the proposed Upper "Y" Improvement Project. 33445{1 )(c) - [The project will assist in eliminating blight] The Agency's Implementation Plan (adopted December 20, 1994) identifies (Page 20) construction of publicly owned facilities as a category of expenses eligible for Agency payment. This includes construction projects on both public parks and streets. The Upper "Y" Landscaping Improvement Project falls into this public facilities category. Underimproved public right-of-way is as much a blighting influence on the Project Area as property held in private hands. Construction of the proposed improvements will replace a barren, underimproved traffic median with an irrigated landscape planter, Construction of these improvements will aid the Redevelopment Agency in meeting its goal of addressing blight in the Project Area. 4.' REDEVELOPMENT PURPOSES AND THE UPPER "Y" PROJECT (33679(cll: As discussed above, public improvement projects qualify as approved projects eligible for Agency funding pursuant to the Agency's Implementation Plan. This project directly addresses an eyesore in the community on a prominent City intersection by improving a blighting condition with irrigated landscaping.
