HomeMy WebLinkAbout5894 RESOLUTION NO. 5894 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, APRIL 9, 1996, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY THE PROVISIONS OF THE CITY CHARTER, AND FOR THE SUBMISSION OF PROPOSED CITY CHARTER AMENDMENTS WHEREAS, under provisions of Section 1100 of the Charter of the City of Arcadia, California, a regular General Municipal Election shall be held on April 9, 1996, for the election of Municipal Officers; and WHEREAS, the City Council also desires to submit to the voters at said election questions relating to amendments to the City Charter; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That pursuant to the requirements of the Charter of the City of j\rcadia, California, there shall be, and there is hereby called and ordered to be held in said City on Tuesday, Apr~l 9, 1996, a General Municipal Election of the qualified electors of the City for the purpose of electing TWO (2) MEMBERS TO THE CITY COUNCIL for the full term of FOUR YEARS; and a CITY CLERK for the full term of FOUR YEARS. SECTION 2: Pursuant to the authority provided by Article XI of the Arcadia City Charter, the Constitution of the State of California, California Government Code and Elections Code, the City Council desires to submit to the voters of said City at the April 9, 1996 General Municipal Election the following proposed amendments to the City Charter: PROPOSITION A. SHALL THE ARCADIA CITY CHARTER BE AMENDED TO UPDATE VARIOUS PROVISIONS OF YES ARTICLE XIV APPLICABLE TO THE ARCADIA BOARD OF EDUCATION? NO 1 5894 SECTION 3. That the full text of the proposed City Charter amendments, Proposition A, are attached as Exhibit "A". PROPOSITION B. SHALL THE ARCADIA CITY CHARTER BE AMENDED TO UPDATE VARIOUS SECTIONS OF THE YES ARCADIA CITY CHARTER WITH REGARD TO TITLES AND FUNCTIONS OF CERTAIN CITY OFFICES AND POSITIONS, CURRENT LEGAL REQUIREMENTS, AND NO GENERAL FISCAL ADMINISTRATION? SECTION 4. That the full text of the proposed City Charter amendments, Proposition B, are attached as Exhibit "B". PROPOSITION C. SHALL THE ARCADIA CITY CHARTER BE AMENDED TO CHANGE THE CITY CLERK FROM AN YES ELECTED OFFICE TO ONE APPOINTED BY THE CITY COUNCIL WITH SPECIFIC JOB RELATED QUALIFICATIONS AND REVISED DUTIES? (EFFECTIVE AT THE CONCLUS ION OF THE TERM OF THE CLERK NO ELECTED IN APRIL, 1996) SECTION 5. That the full text of the proposed City Charter amendments, Proposition C, are attached as Exhibit "C". PROPOSITION D. SHALL THE ARCADIA CITY CHARTER BE AMENDED TO TREAT THE CITY LIBRARY AS COMPARABLE TO OTHER CITY DEPARTMENTS AND TO ACCOMPLISH THE FOLLOWING: YES *DESIGNATE THE LIBRARIAN AS SUBJECT TO APPOINTMENT AND REMOVAL BY THE CITY MANAGER. *LIBRARY EI1PLOYEES SHALL BE PART OF THE CITY CLASSIFIED PERSONNEL SYSTEM. *THE LIBRARY BOARD SHALL HAVE REVISED DUTIES NO TO INCLUDE FINAL DECISION-MAKING AUTHORITY APPLICABLE TO ALL LIBRARY MATERIALS AVAILABLE TO THE PUBLIC? SECTION 6. That the full text of the proposed City Charter amendments, Proposition D, are attached as Exhibit "D". SECTION 7. That the ballots to be used at the election shall be in form and content as required by law. 2 5894 SECTION 8. That the City Clerk is hereby authorized, instructed, and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct said election. SECTION 9. That the polls for said election shall be open at seven 0' clock a .m. on the day of said election and shall remain open continuously from said time until eight o'clock p.m. on the same day when said polls shall be closed, except as provided in Section 14401 of the Elections Code of the state of California. SECTION lO. That in all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections. SECTION 11. That notice of the time and place for holding the election is given and the City Clerk is authorized, instructed and directed to give further or additional notice of the election, in time, form and manner as required by law. SECTION 12, That the City Clerk shall certify to the passage and adoption of this resolution and shall cause notice of the election, the offices to be filled, the proposed amendments to the City Charter, and the other matters relating to the election to be given as required by the Elections Code of the State of California. 3 5894 PASSED, APPROVED AND ADOPTED THIS 5TH DAY OF DECEMBER, 1995. In the preparation of ballots for the election of members for the Board of Education, there shall be printed, stamped, or written the names of each candidate for such office who has filed the required documents pursuant to the requirements of the general law of the State relating to the election of Boards of Education. Any ordinance declared by the Council to be necessary as an emergency measure for preserving the public peace, health, or safety and containing a statement of the reasons for its urgency, may be introduced and adopted at one and the same meeting if it is read in full and passed by at least four affirmative votes. There shall be a City Manager who shall be the chief administrative officer of the City. IN GENERAL. Section 804. MEETINGS. CHAIRMEN. As soon as practicable, following the first day of July of every year, each of such boards and commissions shall organize by electing one of its members as presiding officer, and another as chairman pro tempore, to serve at the pleasure of such board or commission. Each board or commission shall hold regular meetings as the Council may require, and such special meetings as otherwise may be necessary. The provisions of Section 4ll hereof, relating to the Ralph M. Brown Act, shall apply to all meetings of boards and commissions and, subject to the provisions of said Act, all meetings shall be open to the public. The affirmative vote of a majority of the quorum of such board or commission shall be necessary for it to take any action. The City Manager may designate a City employee for the recording of minutes for each of such boards and commissions, who shall keep a record of its proceedings and transactions. No City employee shall take any part in any political campaign while in a uniform bearing the insignia or name of the City of Arcadia. No person shall use the administrative offices and facilities of the City for the purpose of furthering a political campaign for public office. ARTICLE XII FISCAL ADMINISTRATION Section 1203. CAPITAL PROGRAM. As used in this section, a capital improvement shall mean an improvement with an estimated cost in excess of SlO,OOO $30,000. (a) Submission to Council. The Council shall maintain unrestricted cash reserves that are adequate for the purpose of placinq the payment of the operatinq expenses of the City on a cash basis. Said reserves shall consist of cash funds from any available sources in an amount which the Council deems sufficient with which to meet all lawful demands against the City for the first five months or lonqer necessary period of the succeedinq fiscal year prior to the receipt of ad valorem tax revenues. section 1214. PRESENTATION AND AUDIT OF DEMANDS. Any demand against the City must be in writing and may be in the form of a bill, invoice, payroll, or formal demand. Each such demand shall be presented to the Direetsr sf riRaRee individual in charge of the finance office, who shall examine the same. If the amount thereof is legally due and there remains on ~ the books an unexhausted balance of an appropriation against which the same may be charged, fie such individual shall approve such demand and draw ~ a warrant on the Treasurer therefore, payable out of the proper fund. The Direetsr of riRaRee individual in charge of the finance office shall transmit such demand with ~ approval or rejection thereof endorsed thereon, and warrant, if any, to the City Manager. If a demand is one for an item included wi thin an approved budget appropriation, it shall require the approval of EXHIBIT "B" (CONTINUED) EXHIBIT "B" (CONTINUED) the City Manger; otherwise it shall require the approval of the Council, following the adoption by it of an amendment to the budget authori.zing such payment. Any person dissatisfied with the refusal of the City Manager to approve any demand, in whole or in part, may present the same to the Council which, after examining into the matter, may approve or disapprove the demand in whole or in part. Section 1217. INDEPENDENT AUDIT. The ~ Council shall employ, at the beginning of each fiscal year, a certified public accountant who shall, at such time or times as may be specified by the ~ Council and at such other times as he shall determine, examine the books, records, inventories, and reports of all officers and employees who receive, handle or disburse public funds and all such other officers, employees, or departments as the ~ Council may direct. As soon as practicable after the fiscal year, a final certified audit and report shall be submitted by such accountant to the ~ Council, one copy thereof to be distributed to each member, one to the City Manager, DiFeetaF af Fin3Rcc, Treasurer, and City Attorney respectively, and three additional copies to be placed on file in the office of the City Clerk where they shall be available for inspection by the general public. The Council shall appoint the person whom it believes best qualified on the basis of executive and administrative qualifications, with specific reference to the duties of the office as set forth in this Charter, and a Council approved job description and qualifications as recommended by the City Manager. Section 503. VACANCIES. FORFEITURE OF OFFICE. FILLING OF VACANCIES. Until April 18, 2000, the provisions of Section 403 ,subdivisions (a) and (b) hereof, relating to vacancies on the Council shall apply to the office of City Clerk in the same manner as they apply to the office of Council Member.
