HomeMy WebLinkAbout5161 RESOLUTION NO. 5161 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA OPPOSING THE "CABLE TELECOMMUNICATIONS ACT OF 1983" (H. R. 4103) WHEREAS, a portion of the City of Arcadia is currently wired to receive cable television services; and WHEREAS, the City of Arcadia is currently negotiating for the extension of the existing cable television plant which will make cable television services available to all portions of the City; and WHEREAS, the City has been disappointed with the existing cable television services and has been negotiating with the current cable television operator to rectify the system problems; and WHEREAS, it is likely that the existing cable television operator will enjoy exclusivity within the community and will be the only telecommunications medium with a direct link to the homes of local residences with its facilities traversing the public property; and WHEREAS, the best approach to franchising and the resolution of system prOblems is the direct negotiation between the City of Arcadia and independent cable companies, unfettered by the presence of third parties including State and Federal governments; and WHEREAS, the passage of the "Telecommunications Act of 1983" (H.R. 4103) in its current form is one-sided in favor of cable operators to the extent that it would hinder the City's ability to require a minimum level of cable television service at a reasonable cost; and WHEREAS, this one-sidedness is evidenced by provisions which would curtail the City's ability to regulate rates, allow a cable operator to abrogate portions of franchises requiring the delivery of specified services, strip the City of its authority to require reasonable upgrades to an existing .. .. . plant or to deny renewal of a franchise to an operator who has provided poor service, not grandfather certain existing franchises, restrict the City from requiring specific leased access services; and NOW, THEREFORE, be it resolved that the City Council of the City of Arcadia opposes the passage of the "Cable Telecommunications Act of 1983" (H.R. 4103), in its current fonn and any other federal cable television legislation which restricts the City's ability to negotiate or enforce a Cable Television Franchise ordinance; and, BE IT FURTHER RESOLVED, that the City Council of the City of Arcadia, directs the City Clerk to send copies of this resolution to the members of the House, Energy and Commerce Committee.
