HomeMy WebLinkAbout5165 RESOLUTION NO. 5165 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING THE GENERAL PLAN LAND USE DESIGNATION FOR A PORTION OF THE PROPERTY AT '285 WEST HUNTINGTON DRIVE FROM "HORSE RACING" TO "COMMERCIAL" WITH STATEMENT OF OVERRIDING CONSIDERATION RELATING TO MITIGATION MEASURES AND PROJECT ALTERNATIVES FOR G.P. 83-l WHEREAS, an application G.P. 83-l was filed on July 2l, , 1983 by the Los Angeles Turf Club, Inc., hereinafter referred to as "Applicant", requesting a general plan change from "Horse Racing" to "Commercial" on a portion of the property at 285 West Huntington Drive, more particularly described in attached Exhibit "A" hereinafter referred to as "Property", for the purpose of constructing a seven-story 84,000 sq. ft. medical office building. WHEREAS, a public hearing was held on February 7, 1984 by the City Council at which time all interested persons were given full opportunity to be heard and to present evidence; WHEREAS, the Applicant has acknowledged and agreed to all of the conditions set forth in this Resolution. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE, FIND AND DETERMINE AS FOLLOWS: SECTION l. Based upon an initial study prepared for this project which disclosed some potentially substantial adverse effects on the environment, an Environmental Impact Report (EIR) was prepared. Whereas, on November l5, 1983 a duly noticed public hearing was conducted by the City Council on the draft EIR at which time all interested parties were given full opportunity to be heard. On December 20, 1983 the City Council adopted Resolution 5156 adopting, as the lead agency, the final environmental impact report for the proposed medical office bulding at the Santa Anita Race Track and certifying its preparation in compliance with the California Environmental Quality Act, State Guidelines and City of Arcadia rules implementing the same. 5165 SECTION 2. As the lead and responsible agency in approving this general plan change, we hereby certify that we have reviewed and considered the information contained in the final EIR prepared for this project prior to approval of general plan change G.P. 83-l for development of the property. SECTION 3. We hereby further find and determine as follows: A. The significant environmental impacts identified in the EIR will be mitigated by the mitigation measures which will be taken to eliminate such impacts to the extent necessary as follows (all references herein are to the EIR and are by this reference incorporated herein). 1. The Land Use environmental impacts are identified on pages l3 and l5 of the EIR. These effects will be mitigated as per Mitigation Measures outlined on pages l5 and l6 of the EIR. 2. The Traffic and Circulation environmental impacts are identified on pages l7, l8, 20 and 22 of the EIR. No mitigation measures are necessary. It is recommended that in order to enhance public transportation to the site and encourage increased ridership, that the applicant work closely with the RTO to provide a convenient bus passenger loading area along Huntington Drive. 3. The Sewer Facilities and Service environmental impacts are identified on Page 26 of the EIR. These effects will be mitigated as per Mitigation Measures outlined on page 26 and 27 of the EIR. SECTION 4. We hereby further find and determine that specific economic, social and other overriding considerations, however, make infeasible project alternatives identified in the EIR. We hereby find and determine these considerations are as follows: l. A feasibility study prepared for the race track has indicated that there is a need for a medical office building in close proximity to the Arcadia Methodist Hospital. There are only -2- 5165 a few areas in the City that contain the square footage necessary to accommoate an 84,000 square feet building. The majority of these areas are east of Santa Anita Avenue located in the City's "downtown area". These properties, however, do not meet the demand for a location adjacent to the hospital which provides direct access to the hospital. Also, the proposed bui~ding is compatible with the existing uses in the project environs, especia~ly the hospital with which it will be closely associated. 2. In order to ensure that adequate parking is available to patrons, the project will be required to provide 456 parking spaces. A total of 465 spaces is reflected in the plan and the majority of these spaces shall be made available to the Santa Anita Race Track on Saturdays, Sundays and holidays. 3. ~rhe only unavoidable impacts which will not be mitigated with project implementation are the general plan amendment and zone change which constitute changes to the long- range land use designations established for the property and race track. The Cit:y will be reviewing the residential alternative planned for the area in view of the higher intensity land uses which presently exist in the area. 4. The alternatives listed in the EIR were deemed unacceptable for the following reasons: (l) an alternative site location was deemed unacceptable because it did not address the need for a medical office building in close proximity to the hospi tal; (2) a 3 story 84,000 sq. ft. facility was deemed unacceptable because the building would require a greater area of land coverage and would eliminate more race track parking; (3) a 3 story 42,000 sq. ft. building was deemed unacceptable because this alternative falls significantly short of the demand expressed in the survey undertaken by the applicant. SECTION 5. That we hereby adopt as findings of fact all staff reports on file in the Arcadia Planning Department and the City Clerk's office for G.P. 83-l. -3- 5165 SECTION 6. That the General Plan designation shall be amended from "Horse Racing" to "Commercial" for a portion of 285 West Huntington Drive as legally described in Exhibit "A" with the condition that if the zone change (Z-83-4) and Tentative Parcel Map (T.P.M. 83-6) are not approved for this site or if construction of the seven-story, 84,000 square foot medical office building project is not started by June 30, 1985, subject to possible extension of time by the City, the general plan shall revert to its current status of "Horse Racing". SECTION 7. That the City Council hereby finds: A. That the Planning Commission after a duly noticed public hearing on December l3, 1983, adopted on January lO, 1984, Resolution l25l recommending approval of amending the General Plan for said property from "Horse Racing" to "Commercial". B. That said change in the General Plan Land Use designation would not be incompatible with existing uses in the area and that the General Plan change would allow for a desirable development of the area. C. That the City Council has reviewed and considered the Environmental Impact Report prepared for this project and the "Alternatives to the Proposed Project" and has concluded that the proposed projects is an appropriate development on this site, and that the public necessity, convenience and general welfare justify the proposed change. ~ -4- 5165 I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the 2lst day of February, 1984 by the affirmative vote of at least three Council Members, to wit: AYES: NOES: ABSENT: Councilman Haltom, Hannah, Pellegrino and Lojeski Councilan Dring ~~ . - City Clerk of the City of Arcadia SIGNED AND APPROVED.
