RESOLUTION NO. 5187
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARCADIA, CALIFORNIA, APPROVING
THE DECISION OF THE PLANNING COMMISSION
AND DENYING THE APPEAL CONCERNING
CONDITIONAL USE PERMIT NO. 84-8 WITH
FINDINGS
WHEREAS, on April 16, 1984, an application was filed by Orlando
Clarizio to expand the ,existing 74 bed convalescent hospital to l60
beds, Planning Department Case No. C.U.P 84-8, on property commonly
known as l60l South Baldwin Avenue, more particularly described as
follows:
Portion of Lot 4, Block G in the Santa Anita
Land Company's Tract, located in the City of
Arcadia, County of Los Angeles, State of
California.
WHEREAS, a public hearing was held on May 8, 1984, at which time
all interested persons were given full opportunity to be heard and to
present evidence; and
WHEREAS, pursuant to review of the record including staff reports
and testimony, the Planning Commission denied Conditional Use Permit
84-8; and
WHEREAS, applicant appealed the decision of the Planning
Commission to the Arcadia City Council; and
WHEREAS, on July 3, 1984 the City Council conducted a public
hearing on the appeal; and
WHEREAS, at the conclusion of the public hearing the City Council
denied the appeal and directed the preparation of findings reflective
of and consistent with their decision; and
WHEREAS, as part of the record of this proceeding the City
Council reviewed and considered the following:
a. All staff reports and related attachments, and exhibits submitted
by the Planning Department to the Planning Commission and City
Council;
b. The record of the Planning Commission hearing regarding
Conditional Use Permit No. 84-8;
c. Written communications submitted by the applicant and his
attorney along with communications submitted by those in favor of
and in opposition to the Conditional Use Permit; and
d. All oral presentations made during the public hearing of July 3,
1984.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION l. Conditional Use Permit 84-8 is hereby denied pursuant
to the following findings:
SECTION 2. FINDINGS.
a. A convalescent hospital is a permitted use in the R-3 Zone with
an approved Conditional Use Permit.
b. Concerning Conditonal Use Permit No. 84-8, the site for the
proposed use is inadequate to accommodate said use and is
detrimental to the welfare of the vicinity because:
l. The proposed expansion is too intense for subject site
and does not comply with Section 9275.l5.3 of the
Arcadia Municipal Code which allows a maximum density of one
bed for each 800 square feet of lot area.
2. There is inconsistency with minimum parking requirements in
that the parking does not comply with Section 9275.5.4 of the
Arcadia Municipal Code which requires one (1) parking space
for every two (2) beds and future employee parking could
create a parking deficiency.
3. Access and turn around to the rear parking area for
emergency equipment is not adequate.
4. There is insufficient open space on subject site.
c. That for the foregoing reasons the Council determines that the
granting of Conditional Use Permit No. 84-8 would be detrimental
to the welfare of property in the vicinity, injurious to such
property and inconsistent with the proper development in the area
and zone and, therefore, denies Conditional Use Permit No. 84-8.

SECTION 3. The City Clerk shall certify to the adoption of this
Resolution.
