HomeMy WebLinkAbout5189 RESOLUTION NO. 5189 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 9 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARCADIA AS FOLLOWS: WHEREAS, the City Council of the City of Arcadia, at its regular meeting of July 3, 1984, called for a public hearing on August 21, 1984, at the hour of 7:30 o'clock p.m., in the Council Chambers at the City Hall, Arcadia, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service, within that certain area of the City described as follows: Beginning at the intersection of a line that is parallel with the easterly line of Baldwin Avenue (103 feet wide) and distant westerly B feet from said easterly line, and a line that is parallel with and distant southerly 25 feet from the southerly line of Huntington Drive as same existed on July 19, 1984; thence northerly along first mentioned parallel line to a line that is parallel with and distant northerly 25 feet from the northerly line of said Huntington Drive; thence westerly along last said parallel line to its intersection with the westerly line of Michillinda Avenue (67 feet wide); thence southerly along said westerly line and its southerly prolongation to aforementioned parallel line being distant southerly 25 feet from aforesaid southerly line of Huntington Drive; thence easterly along last said parallel line to the point of beginning. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arcadia, that pursuant to Ordinance No. 1375 of the City of Arcadia, the above-described area is hereby declared an underground utility district and is designated as Underground Utility District No.9 of the City of Arcadia. RESOLVED, FURTHER, that the City Council does hereby fix August 15, 1985 as the date on which affected property owners must be ready to receive underground service and does hereby order the removal of all poles, overhead wires, and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or asociated service with Underground Utility District No. 9 on or before September 30, 1985. RESOLVED, FURTHER, that the City Council of the City of Arcadia hereby finds and determines that the Public necessity, health, safety, and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and associated structures, and the underground install at ion of wires and faci 1 it ies for supplying electric, communication or similar or associated service in said area. RESOLVED, FURTHER, that said City Council finds and determines: 1. That the undergrounding to be accomp 1 i shed pursuant to th i s resolution will avoid or eliminate an unusually heavy concentration of overhead distribution facilities. 2. The streets, roads or right-of-ways in said area are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic. . . RESOLVED FURTHER, that the City Clerk, within ten (10) days after the adoption of this resolution, shall mail a copy hereof and a copy of Ordinance No. 1375 to affected property owners as such are shown on the last equa 1 ized assessment ro 11 and to the affected ut i 1 it ies.
