CITY COUNCIL RESOLUTION NO. 5197
A RESOLUTION OF THE ARCADIA CITY COUNCIL DECLARING
LOT 1583 OF CHICAGO PARK SURPLUS PROPERTY AND
AUTHORIZING ITS SALE TO TAYLOR CONSTRUCTION COMPANY
WHEREAS, The City of Arcadia owns fee title to that land described
generally as Lot 1583 of Chicago Park in the City of Arcadia (see Legal Description
in Preliminary Title Report - 8157699 dated August 1,1984 attached as Exhibit "A");
and
WHEREAS, Ron V. Taylor, President of Taylor Construction Company has
offered to buy said City lot for $14,445.00 ($4.50 per square foot) and has provided
a check (No. 8475, dated September 4,1984 in the amount of $1,000.00 as evidence
of good faith) and shall include said City lot in his planned development of
Lots 1584 through 1589 located to the immediate east (Attachment "B"); and
WHEREAS, the City has had the value of Lot 1583 appraised by two qualified
Appraisers, and has determined that the offer by Ron V. Taylor is fair market value
for the site as determined by these appraisals; and
WHEREAS, the City Council desires to see the Chicago Park area developed
and finds the proposed plans as submitted by Taylor Construction Company for the
development of an office and construction yard on Lots 1584 - 1589 immediately
to the east of Lot 1583 and on Lot 1583 is an attractive development (said plans are
now on file in the Planning Department); and
WHEREAS, the sale of the above described City property to Taylor Construc-
tion would assist in both his plans to develop Lots 1583 - 1589 and in the City's
desires to see Chica90 Park developed as an attractive industrial park; and
WHEREAS, the City does not util ize the subject property for any specific
public service; nor, is the subject property necessary for public services or
facil iti es.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ARCADIA AS FOLLOWS:
Section 1. That the City-owned property described above as Lot 1583 of
Chicago Park is declared surplus.
Section 2. That the City of Arcadia agrees to sell to Taylor Construc-
tion Company the City-owned land (Lot 1583) described in Attachment "A" in exchange
for $14,445.00 in cash, subject to execution and recordation of a Covenant and
Agreement to Develop and Hold Property As One Parcel, and, subject to the design,
construction, maintenance and use of the surplus parcel as set forth in his building
plans now on file in the Planning Department.
Section 3. The City Manager or his authorized designee is directed to
execute and record all of the necessary documents to finalize the above transaction,
subject to the approval of same as to form by the City Attorney.
BE IT FURTHER RESOLVED that the City Clerk shall certify to the adoption
of this Resolution.
I HEREBY CERTIFY that the forgoing Resolution was adopted at a
meeting of the Arcadia City Council held on the 2nd day of October
by the affirmative vote of at least three City Council Members, to wit:
