RESOLUTION NO. 5939
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, SETTING PRIORITIES FOR FILING
WRITTEN ,ARGUMENTS REGARDING AN INITIATIVE MEASURE
AND DIRECTING THE CITY ATTORNEY TO PREPARE AN
IMPARTIAL ANALYSIS
WHEREAS, A Special Municipal Election is to be held in the
City of Arcadia, California, on the 5th day of November, 1996, at
which there will be submitted to the qualified voters of said
city the followi.ng initiative measure:

That the text of the proposed initiative ordinance to be
submi tted to the electorate is attached to this resolution as
"Exhibit AU.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That the City Council authorizes The City
Council (Mayor Barbara D. Kuhn, Mayor Pro Tern Robert C. Harbicht,
Dr. Sheng Chang, Dennis A. Lojeski and Mary B. Young) to file
written arguments not to exceed 300 words against the initiative
measure as specified above in accordance with Article 4, Chapter
3, Division 9 of the Elections Code of the State of California
and to change the argument until and including August 13, 1996,
the date fixed by the City Clerk after which no arguments for or
against the City measure may be submitted to the City Clerk.
SECTION 2. That the City Council directs the City Clerk to
transmit a copy of the initiative measure to the City Attorney,
unless the organization or salaries of the office of the City
Attorney are affected. The City Attorney shall prepare an
impartial analysis of the measure showing the effect of said
measure on existing law and the operation of the initiative
measure. If the measure affects the organization or salaries of
the office of the City Attorney, the City Clerk shall prepare the
impartial analysis. The impartial analysis shall be filed by the
date set by the City Clerk for the filing of primary arguments.
SECTION 3. That the City Clerk shall certify to the passage
and adoption of this resolution.

"EXHIBIT AU
THE PEOPLE OF ARCADIA DO ORDAIN AS FOLLOWS:
Section 1. Purpose and Findings.
WHEREAS, the property known as the Santa Anita Racetrack at
285 W. Huntington Drive, Arcadia, California 91007-3417 and
described on the attached map of the Arcadia General Plan, is
currently designated for horse racing in the General Plan, and is
zoned S-l a Special Use for Horse Racing;
WHEREAS, traffic congestion in the vicinity of the race
track already exists, resulting in unhealthful levels of air
pollution and impairing the mobility of current residents and
visitors;
WHEREAS, a dramatic and concentrated increase in commercial
growth would exceed the capacity of the City to provide necessary
city services, such as police, fire, and sanitary services;
WHEREAS, the construction of the Entertainment Center
proposed by Santa Anita Realty Enterprises, Inc., as part of the
application for a zone change Z95-00l would fundamentally change
the character of the community and adversely impact the quality
of life that has made Arcadia an attractive place to live, now,
therefore,
Section 2.
Section 25g of the General Plan, Land Use Element, is
amended to read:
This designation applies to the area of the city used for horse
racing. Because of the unique nature of the horse racing and the
size and location of the property within the City and the desire
to see this use continue; the site is designated for this special
use. This section will not be amended to allow any use other
than horse racing except by a majority vote of the people.
