HomeMy WebLinkAbout5949 RESOLUTION NO, 5949 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION TO ANNEX CERTAIN PARCELS TO THE ARCADIA CONSOLIDATED LIGHTING MAINTENANCE DISTRICT (ANNEXATION NO, 16) AND SETTING A TIME FOR PUBLIC HEARING WHEREAS, the public interest, and convenience require the improvement, to wit, operation and maintenance, of certain street lighting systems on parcels which are presently outside of the Arcadia Consolidated Lighting Maintenance District, and WHEREAS, the public interest and convenience require said parcels to be annexed to said District for the purpose of assessing said parcels for the costs and expenses of supplying electrical energy and maintain said street lighting systems. NOW, THEREFORE, THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require that certain lighting systems on parcels herein described be maintained and supplied with electrical energy and that the cost thereof be assessed to said parcels. SECTION 2. That the public interest and convenience require that parcels be annexed to the Arcadia Consolidated Lighting Maintenance District and that a map showing said boundaries of the parcels proposed for annexation to said District, and the particular zone of said District into which said parcels shall be placed, together with a map of the Arcadia Consolidated Lighting District, is attached to the report of the City engineer relating to this proceeding, dated September 26, 1996 and entitled -1- Engineer's Report Regarding Annexation No, 16 to the Arcadia Consolidated Lighting Maintenance District, which report has been considered by the City council and is on file and available for inspection in the office of the city Clerk in the City Hall; that said report and maps are hereby incorporated herein by reference as though set forth in full; that all said parcels will be benefited by operation and maintenance of the lighting system therein. SECTION 3. That the improvement (operation and maintenance) of the street lighting systems referred to herein shall be for a period commencing July 1, 1997, and ending June 30, 2010. SECTION 4. Notice is given that on Tuesday, 5th day of November, 1996, at the hour of 7:00 p.m. in Council Chambers of the City Hall, 240 S. Huntington Drive, Arcadia, California, the City Council will hear protests of any interest persons who object to the proposed improvement or to the assessment therefor. SECTION 5. That the City Clerk shall certify the adoption of this Resolution. All such districts were consolidated into a single district by Resolution No. 4173 in 1970 and have had additional parcels annexed to the various zones therein. Pursuant to your order of September 3, 1996, the Acting City Engineer submits this report in accordance with the provisions of the "streets and Highways Code of the state of California", using the alternative procedure for levying and collecting assessments on an "Ad Volorem" basis, as provided for in Chapter 8.5 of said part and division. Plans and SDecifications Reference is made to drawings of' the areas to be annexed or transferred which are titled Annexation No. 16, Arcadia Consolidated Lighting Maintenance District (18 sheets) filed with the city Clerk, which constitute the street lighting plan of parcels to be annexed to said district and show the following: 1. ,Annexation boundaries of the various district zones. 2. Parcels within said zones. 3. Types and approximate locations of street lights to be added. The zone to which land is to be annexed is generally described as follows: See attached s!1ee.ts. MOSTAHKAMI, ACTING CITY ENGINEER ~ BY: DAN LAZO, ASSISTANT ENGINEER PREPARED BY: TIM KELLEHER, SENIOR ENGINEERING AIDE SUBJECT: RECOMMENDATION TO CONSIDER ENGINEER'S REPORT AND ADOPT RESOLUTION NO. 5949, DECLARING ITS INTENTION TO ANNEX CERTAIN PARCELS INTO THE ARCADIA CONSOLIDATED LIGHTING MAINTENANCE DISTRICT (ANNEXATION NO.16) AND SETTING A TIME FOR A PUBLIC HEARING SUMMARY since 1988, 110 street lights have been either installed, upgraded or converted from high voltage to low voltage within the ci ty. In order to be able to charge those property owners benefiting from the new and modified street lights, the City must annex an estimated 269 properties into the Consolidated Lighting Maintenance District (CLMD) . Pursuant to City council's direction of September 3, 1996, staff prepared the Engineer's Report and filed it with the City Clerk on September 26, 1996. It is recomm~nded that the City Council consider the Engineer'S Report and adopt Resolution No.5949, declaring its intention to annex certain parcels into the CLMD, and setting a time for public hearing on November 5, 1996 city Council Meeting. DISCUSSION In 1970, the City Council formed the Consolidated Lighting Maintenance District for the purpose of levying assessments on parcels that directly benefit from street lights installed within its borders. These assessments pay for the energy, maintenance, and any capital improvements required in the District. Although the amount of the assessment is evaluated annually, there has not been any change to the number of parcels included in the CLMD since 1988. Now, with the additional streetlights that have been installed, it has become economically feasible to proceed with the annexation. Mayor and city council October 1, 1996 Page 2 Changes to the CLMD must be done in accordance with the Streets and Highways Code section 18000 et. Seq. Section 18040 of the code denotes that if the City wishes to annex properties into the district that the City Council must direct the City Engineer to file an Engineer's Report stating such with the City Clerk. Pursuant to City Council's direction of September 3, 1996 meeting, an Engineer's Report was prepared and filed with the city Clerk on September 26, 1996. Pursuant to Streets and Highways Code Section 18042, a copy of the Engineer's Report is attached for City council's consideration. The Engineer's Report includes the following: . Plans and Specifications - A description of the type of light in each zone and maps showing the locations of the lights involved (on file in the Engineering and City Clerk's Office). . Estimate of Costs - Cost of improvement for the period of time during which it is proposed to be continued. . Diagram of District - Maps showing the proposed parcels to be annexed into the district (on file in the Engineering and City Clerk's Office). . Proposed Assessment - A proposed assessment of the total amount of the costs and expenses of th~ proposed improvement. In accordance with section 18060 of the Streets and Highway Code, if the City Council so desires to proceed with the annexation proceedings it shall adopt Resolution No. 5949, declaring its intention to annex those parcels shown in the Engineer's Report into the District and hold a public hearing on November 5, 1996. The street lighting maintenance district runs until June 30, 2010. FISCAL IMPACT The estimated total cost (energy and maintenance costs, State Fee, and engineering and posting Costs) for the first year beginning July 1, 1997 is $17,800 of which $14,640 will be paid by the District and $3,160 will be paid by the City (Table 1).
