RESOLUTION NO. 4867
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARCADIA APPROVING THE APPLICATION OF GARY
A. GRIMM FOR DISABILITY RETIREMENT AND FINDING
THAT HE IS INCAPACITATED TO PERFORM HIS DUTIES
AS POLICE OFFICER.
WHEREAS, the City of Arcadia (hereinafter referred to as
Agency) is a contracting agency of the Public Employees' Retirement
System;
WHEREAS, the Public Employees' Retirement Law requires that
a contracting agency determine whether an employee of such agency
in employment in which he is classified as a local safety member is
disabled for'purposes of the Public Employees' Retirement Law and
whether such disability is "industrial" within the meaning of such
Law;
WHEREAS, an application for disability retirement of Gary A.
Grimm, employed by the Agency in the position of Police Officer,
has been filed by Gary A. Grimm with the Public Employees' Retirement
System; and
WHEREAS, the City Council has reviewed the medical and other
evidence relevant to such alleged disability.

NOW, THEREFORE, BE IT RESOLVED that the City Council find
and determine and it does hereby find and determine that Gary A.
Grimm is incapacitated within the meaning of the Public Employees'
Retirement Law for performance of his duties in the position of
Police Officer; and
BE IT FURTHER RESOLVED that the City Council find and deter-
mine and it does hereby find and determine that such disability is
a result of injury or disease arising out of and in the course of
employment and neither Gary A. Grimm nor the Agency has applied to
the Workers' Compensation Appeals Board for a determination pursuant
to Section 21026 whether such disability is industrial; and

BE IT FURTHER RESOLVED that the member was or will be
separated from his employment in the position of Police Officer
after expiration of his leave rights under Section 21025.4,
Government Code, effective December 1, 1979, and that no ,dispute
as to the expiration of such leave rights is pending.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia held
on the 4th
day of December, 1979, by the affirmative vote of
at least three Councilmen, to wit:

On October 11, 1979, Sam J, Falzone appealed the Planning
Commission's denial of Conditional Use Permit 79-15 for
the construction of a 47 unit condominium at 509-523 West
Duarte Road, Mr. Falzone noted in his letter "If it is at"
all possible, at the time of the hearing of denial, it would
be appreciated if we could receive an approval of the project
with conditions. even if it reouired deletion of 1, 2 or 3

The City Council at ltS November 6, 1979 meeting r_ferred this
back for its review and recommendation, This is not a public
hearing,
The applicant'S revised plans have deleted two
center of the project for a total of 45 units.

The applicant is requesting a modification to allow thirty-five
foot high buildings measured at the garage level (same as the
original plan). There will be 26 two-bedroom units ranging
in size from 1186 square feet to 1565 square feet and 19 three-
bedroom units with 1629 square feet,
Parking
Nine guest parking spaces are provided on the site and each unit
has an attached two-car garage (2.2 parking spaces per unit).
Six guest parking spaces are centrally located, the remaining
three are interspersed among the buildings,

Access will be from two 26 foot wide driveways off of Arcadia
Avenue, There will be no access from Duarte Road,

There is approximately 39% (not including the planter strips
adjacent to the driveway and open parking spaces) open space
on the site, 6,9~ of which is in common open space.
Miscellaneous Information
The trash areas have been equally distributed between the units.
The proposed 4' high slumpstone wall,has been moved out of the
required setback on Duarte Road,
Analysis
The revised plan is not consistent with the following amendments
to the R-3 regulations being considered by the Planning Commission
ad hoc committee':
1) 2,5 parking spaces per unit
2} A 30 foot back-up area
3} A mlnlmum of 200 square feet of private outdoor open
space shall be provided; when access is gained through
this private area, a minimum of 230 square feet shall
be provided,

4) 30% of the lot area shall be in open space; 7% of
which shall be in a common area centrally located

Action
The City Council is requesting that the Planning Commission review
the revised plans and make a recommendation.
