HomeMy WebLinkAbout4878 RESOLUTION NO. 4878 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA AMENDING RESOLUTION NO. 4778 BY REDUCING THE VARIANCE AND CONDITIONAL USE PERMIT FILING FEES FOR PROPERTIES OF LESS THAN 10,000 SQUARE FEET IN SIZE AND FOR REVISIONS OF CONDITIONS OF APPROVAL, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY RESOLVE AND DETERMINE AS FOLLOWS: SECTION 1, That Section 2 of Resolution No. 4778 is hereby amended to 'read'as follows: "SECTION 2. Pursuant to Arcadia Municipal Code Sections 9275.2.2 and 9291.2,2, there is herebj established the following fee schedule for condition~l use permits and variances: Under SIZE OF PROPERTY - SINGLE USE * 5000 10000 15000 25000 35000 45000 55000 65000 75000 85000 and 5000 sq. ft. 9999 14999 24999 34999 44999 54999 64999 74999 84999 over FEE $ 225 275 325 375 425 475 525 575 625 675 725 25 Extension Fee * For proposed uses on properties with multiple uses or for uses with an existing Conditional Use Permit the fee shall be based on the square foot~ge of the proposed use (or additional or altered proposed use), including required parking computed at 350 square feet per required space, For proposed revision~ to existing conditions of approval the fee shall be $150, - 1 - 4878 SECTION 2. That the fees adop~ed herein are less than the reasonable cost of ,providing the service or regulatory activity for which the fees are charged and are not levied for general revenue purposes. SECTION 3, Neither the adoption of this resolution nor the repeal or amendment hereby of any re~ol~tion shall in any manner be construed as affecting any of the provisions of such resolution relating to the collection of any such fee, nor to affect the validity of any bond or cash deposit in lieri thereof, posted, filed or deposited therefore and all rights and obligations thereunder appertaining shall continue in full force and effect. SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this resolution is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent juris- diction, such decision shall not affect the validity of the remaining portions of this resolution. The City Council of the City of Arcadia hereby declares that it would have adopted this resolution and each section, subsection, sentence, clause, phrase or portion thereof, irrespective of the fact that anyone or more sections, subsections, sentences, clauses, phrases or portion~ be declared invalid or uncon- stitutional. SECTION 5. This resolution shall become effective January 2, 1980. SECTION 6, That the Clerk of the Council shall certify to the adoption of this resolution.
