RESOLUTION NO. 5123
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARCADIA, CALIFORNIA, ORDERING AND CALLING A
SPECIAL ELECTION TO BE HELD IN SAID CITY ON
DECEMBER 13, 1983, OR THE SECOND TUESDAY IN
APRIL, 1984, AND ORDERING THE SUBMISSION TO
THE QUALIFIED ELECTORS OF THE CITY OF ARCADIA
OF A QUESTION RELATING TO A CHARTER AMENDMENT
WHEREAS, purusant to authority provided by the
California State Constitution and California Government Code
(Section 34459), the City Council of the City of Arcadia desires
to submit to the electors of said City a proposed Charter
Amendment relating to City Council elections; and
WHEREAS, the City Council of said City is thereupon
authorized and directed by statute to submit the proposed Charter
Amendment to the qualified voters;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE, AND ORDER AS
FOLLOWS:
SECTION 1. That pursuant to Section 1100 and 1101 of
the Charter of the City of Arcadia, California, there shall be;
and there is hereby called and ordered to be held in said City, on
Tuesday, December 13, 1983, a special municipal election of
qualified electors of said City for the purpose of voting on a
Charter Amendment; or, in the event there is no Statewide Special
Election on December 13, 1983, there is hereby called and ordered
in said City an election for the purpose of voting on a City
Charter Amendment to be held with the 1984 General Municipal
Election on the second Tuesday in April.
SECTION 1.5. In the event that a Statewide Special
Election is not held on December 13, 1983, no special municipal
election shall be held on that date and this Resolution shall
therefore call the election on the proposed Charter Amendment for
th~ second Tuesday in April 1984 (General Municipal Election).
SECTION 2. That said City Council pursuant to its right
and authority so to do, does hereby determine that there shall be
and there is hereby ordered submitted to the qualified electors of
said City at the municipal election called for in this resolution,
the following proposed Charter Amendment, to wit:
SHALL AN AMENDMENT TO THE CHARTER OF THE CITY OF
ARCADIA, CHANGING THE NUMBER OF VOTES REQUIRED
TO BE ELECTED TO THE OFFICE OF COUNCILMAN, THE
SCHEDULE OF MUNICIPAL ELECTIONS AND PROVIDING FOR
A RUNOFF ELECTION BE ADOPTED?

SECTION 3. The proposed Charter Amendments submitted to
the voters shall be as follows:
That Sections 400, 1100, and 1102 of the City Charter of
the City of Arcadia be amended and Section 1100.1 be added to the
Charter of the City of Arcadia to read as follows:
Section 400. CITY COUNCIL. The City Council, hereinafter termed
"Council,. shall consist of five Councilmen elected to office from
the City at large in the manner provided in this Charter. The
term of office shall be four years. Alternate, and successively,
three four-year terms shall be filled at one general municipal
election and two four-year terms at the next such election,
consistent with the sequence of terms of Councilmen existing on
the effective date hereof. The term of a Councilman shall
commence on the first regular Council meeting following the date
scheduled for a runoff election and he shall serve until his
successor qualifies. Any ties in voting shall be settled by the
casting of lots.
Section 1100. GENERAL MUNICIPAL ELECTIONS. General Municipal
Elections for the election of officers and for such other purposes
as the city Council may prescribe shall be held in the City in
each even numbered year on such dates as set forth by City
ordinance.
At the General Municipal Election candidates for the
office of councilman in the same number as there are offices to be
filled who receive the highest number of votes but not less than a

majority (one-half) of the qualified electors (voters) who cast
valid ballots at such election for City Council seats, shall be
deemed to be and declared by the council to be elected to such
office or offices and their names shall not be printed on the
ballot to be used at the following runoff election.
Section 1100.1. RUNOFF ELECTION. If the number of candidates
elected at the General Municipal Election is less than the number
of offices to be filled, or if no candidate is elected, the City
Council shall call for a second election at which candidates equal
in number to twice the number of offices remaining to be filled
and who received the highest number of votes at the prior general
election, shall be the only candidates for such office or offices,
at such runoff 'election. Candidates in the runoff election, in
the same number as there are offices to be filled, who receive the
highest number of votes shall be declared elected.
Section 1102. PROCEDURE FOR HOLDING ELECTION. Unless otherwise
provided by ordinance, all elections shall be held in accordance
with the provisions of the Elections Code of the State of
California, as the same now exists or as it may hereafter be
amended, for the holding of municipal elections. The City may by
ordinance fix the day and month for those elections established by
this Charter, so far as the same are not in conflict with this
Charter.
SECTION 4. If the December 13, 1983 State Special
Election is conducted, the City special election shall be
consolidated with the Statewide Special Election to be held on
said date and shall be conducted in accordance with applicable
resolutions and laws.
SECTION 5. Pursuant to Elections Code Section 5010 et
seq., an argument in favor and an argument against the proposed
Charter Amendment and an impartial analysis of the proposed
Charter Amendment shall be printed and distributed to the voters.
SECTION 5. That the Clerk of the Council shall certify
to the adoption of this resolution and cause the same to be
published in a newspaper of general circulation.

r HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the City Council of the City of
Arcadia held on the 13th day of September, 1983, by the
affirmative vote of at least three Councilmen, to wit:
