RESOLUTION NO. 5147
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF
A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON
TUESDAY, APRIL 10, 1984 FOR THE ELECTION OF CERTAIN OFF-
ICERS OF SAID CITY AS REQUIRED BY THE PROVISION OF THE
CHARTER, AND FOR THE SUBMISSION TO THE QUALIFIED ELECTORS
OF SAID CITY OF A MEASURE RELATING TO CITY COUNCIL ELEC-
TlONS.
WHEREAS, under the provisions of Section 1100 of the Charter of the City
of Arcadia, California, a regular general municipal election shall be held on
April lO, 1984, for the election of municipal officers; and
WHEREAS, the City Counc i 1 of sa id City a 1 so des i res to submit to the
qualified electors of said City at said election, proposed measure to amend
the Arcadia City Charter relatin~ to City Council elections, attached hereto
as Exhibit f!,.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA DOES
HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That pursuant to the requirements of the Charter of the City
of Arcadia, California, there shall be; and there is hereby called and ordered,
held in said City on Tuesday, April lO, 1984, a regular municipal election of
the qualified electors of said city for the purpose of electing two (2) Members
of the City Council of said City for the full term of four years; and for a
City Clerk for the full term of four years.
SECTION 2. That said City Council, pursuant to its right and authority
so to do, does hereby determine that there shall be and there is hereby ordered
submitted to the qualified electors of said City at said re~ular municip~l elec-
tion the followino question, to wit:
"Shall an Amendment to the Charter of the City YES
of Arcadia, changing the number of votes required
to be elected to the office of Councilman, the
schedule of electio~s and providing for a runoff
elect ion be adopted." NO

hereinbefore provided shall be counted in favor of the adoption of the measure.
A cross (+) placed in the votino square after the word "NO" in the mnner' herei~bc-
fore provided shall be counted against the adoption of the question.
SECTION 3. That the ballots to be used at said election shall be, both as
to form and matter conta ined therein, such as may be requi red by law to be used
thereat.

EXHIBIT A
PROPOSED CHARTER AMENDMENT
Section 400. CITY COUNCIL. The City Council,
hereinafter termed "Council," shall consist of five Councilmen
elected to office from the City at large in the manner provided in
this Charter. The term of office shall be four years. Alternate,
and successively, three four-year terms shall be filled at one
general municipal election and two four-year terms at the next
such election, consistent with the sequence of terms of Councilmen
existing on the effective date hereof. The term of a councilman
shall commence on the first Tuesday regular meeting fOllowing the
runoff election and he shall serve until his successor qualifies.
Any ties in voting shall be settled by the casting of lots.
Section l100. GENERAL MUNICIPAL ELECTIONS. General
Municipal Elections for the election of officers and for such
other purposes as the City Council may prescribe shall be held in
the City in each even numbered year commencing with the year 1984
on such dates as set forth by City ordinance.
At the General Hunicipal Election candidates for the
office of councilman in the same number as there are offices to be
filled who receive the highest number of votes but not less than a
majority (one-half) of the qualified electors (voters) who cast
valid ballots at such election for City Council seats, shall be
deemed to be and declared by the council to be elected to such
office or offices and their names shall not be printed on the
ballot to be used at the following runoff election.

EXHIBIT A
Section llOO.l. RUNOFF ELECTION. If the number of
candidates elected at the General Municipal Election is less than
the number of offices to be filled, or if no candidate is elected,
the City Council shall call for a second election at which
candidates equal in number to twice the number of offices
remaining to be filled and who received the highest number of
votes at the prior general election, shall be the only candidates
for such office or offices, at such runoff election. Candidates
in the runoff election, in the same number as there are offices to
be filled, who receive the highest number of votes shall be
declared elected.
Section ll02. PROCEDURE FOR HOLDING ELECTION. Unless
otherwise provided by ordinance, all elections shall be held in
accordance with the provisions of the Elections Code of the State
of California, as the same now exists or as it may hereafter be
amended, for the holding of municipal elections. The City may by
ordinance fix the day and month for those elections established by
this Charter, so far as the same are not in conflict with this
Charter.

SECTION 4. That the City Clerk of said City is hereby authorized, in-
structed and directed to procure and furnish any and all official ballots,
notices, printed matter and all suppl ies, equipment and paraphernal ia that
may be necessary in order to properly and lawfully conduct said election.
SECTION 5. That the polls for said election shall be open at seven o'clock
a.m. of the day of said election and shall remain open continuously from said time
until 8 o'clock p.m. of the same day when said polls shall be closed, except as
provided in Section l4301 of the Elections Code of the State of California.

SECTION 7. That notice of the time and place of holding said election is
hereby given and the City Clerk is hereby authorized, instructed and directed to
give such further or additional notice of said election, in time, form and manner
as required by law.
SECTION 8. The City Clerk shall certify to the adoption of this reso!u-
tion and shall cause notice of the election, the offices to be filled and the
other matters relating to the election to be given as requJred by the Elections
Code of,the State of California.
I HEREBY CERTIFY that the foregoing resolution was adopted at a regular
meeting of the City Council of the City of Arcadia held on the 6th day of
December 1983 by the affirmative vote of at least three Council Members to wit:
