A RESOLUrION OF THE CITY Cmn:!ClL OF THE CITY OF ARCADIA
REQUESTING FROIJ THE DEPARTMENT OF PUBLIC WORKS OF THE STATE
OF CALIFORNIA Al{ EXTENSION OF TIME IN\'lHICH TO COMPLETE
CERTAIN WORK PROVIDED TO BE DONE IN A CERTAIN AGREZi,ffiNT
EXECUTED BY THE CITY OF ARCADIA ON l:OV=::BZR, 15th, 1938 AND
EXECUTED BY DEPART~.lENT OF PUBLIC WORKS OF THE STATE OF CALIFORNIA
ON NOVE:rnER 18th, 1938.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS
FOLLOWS:
SECTION 1. WHEREAS, the Director of Finance of the State
of California did on the 16th day of November, 1938, authorize
in writing tJ:,e expenditure of the sum of not to exceed Nine
Thousand Dollars ((?9,000.OO) from the emergency fund provided
for in item 189 of the 1937 Budget Act (Statutes of 1937, p.
423) for the following purposes; (a) for the construction of
a swale cros:ling on Valnett Avenue over Santa Anita Wash be-
tween Eighth and Tenth Avenues, and (b) for the repair and
rehabilitation of bank protection works in and Along Sierra
Madre Wash blltween Grand View Avenue and Santa Anita Avenue, and
l'iHEREAS, that certain agreement made and entered into
between the City of Arcadia and the Department of Public Works
of the State of California on or about the 18th day of November,
1938, and ap~oved by said Director of Finance, provides in
part that sald work might be performed, wholly or in part,
in conjuncti~n with a Works Administration Project, subject to
the approval of said Department of Public Works, and
,mEREAS, pursuant to said agreement the repair and re-
habilitation of bank protection works in and along Sierra
Madre Wash between Grand View Avenue and Santa Anita Avenue
was included in a Works Administration Project, which has
heretofore been approved by the Department of Public Works
as well as by the Los Angeles office of Works Progress Ad-
ministratior.., and said project now awaits ',;he approval of
Works Progress Administration in Washington D. C., and
WHEREAS, aaid project has been set up by Works Progress
Administration as requiring a period of eight months to
complete, and
~HE~EAS, the said agreement heretofore made by the City
of Arcadia and Department of Public Works provides that should
the work mentioned therein not be completed with:~,n one hundred
twenty (120) days from and after the execution of said aGree-
ment, then the Department of Public Works may upon written
notice terminate said agreement, and
WHEREAS this Council believes that final approval by Works
Progress Administration will not be procured prior to April,
18th, 1939,
NOVl THEREfORE IT IS HEREBY ORDERED that the Mayor and
City Clerk be and they are hereby authorized for and on
behalf of the Gity of Arcadia to make written application
to the Departm~t of Public Works for an extension of ten
(10) months from and after the 18th day of February, 1939,
in which to c'mplete said work provided for in said
agreement . I'~ is further ordered that a copy of this
resolution be forwarded with said application for extension.
SECTION 2. The City Clerk shall certify to the adoption
of this nesolu1;10n.
I berElby certify that the foregoing resolution was
adopted at a rElgular meeting of the City Council of the
City of "J'oadh held on the 17th day of January, 1939, by
the affirmative vote of at least three Councilmen, to-wit:
