THE CITY COUNCIL OF THE CITY OF ARCtillIA DOES R.':!:SOLVE AS FOLLO\'lS: SECT::ON 1. That the publ1c interest and convenience require, and it is the lntention of the City Council of the City of Arcadia, to order the followinc; Vlork and improvement to be done in said City of Arc adi a, to.-wi t : First: That a concrete sidel'/alk 5 feet in \'lidth be constructed on each side of Californla Street from the easterly line of First Avenue to the westerly line of second Avenue in said City of Arcadia, including intersecting returns at the intersection of California Street and Second Avenue, except where a concrete sidewalk is already constructed upon either side of said portion of California Street to the official line and grade and is now in good condition. Second: That a concrete curb be constructed upon said portion of California Street from the easterly line of First Avenue to the westerly line of Second Avenue, along a line distant 12 feet southerly from and parallel to the northerly line of said California street; that a concrete curb be constructed uryon said portion of Cellfornia Streat frOG the easterly line of First Avenue to the westerly line of Second Avenue, alon~ a line distant 12 feet northerly from and parallel to the southerly line of said California Stneet, except where a concrete curb is already constructed upon said portion of California Street to the official line and grade and is now in good condition. Third:: That a concrete 8utter be constructed on the northerly and southerly sides of said portion of California Street from the easterJ.y line of First Avenue to the I'lesterlyline of Second Avenue. -1- Fourth: That the roadway space in said portion of California Street between the northerly ;.utter line thereof and the existing 01.1 Hacadam pavement in said portion of California Street be Grade'd and paved \"lith an Oil L;acadam pavement trio (2") inches thick, ~~d that the roadway space in said portion of California Stre'et between the southerly Gutter line thereof and the existing 0:1.1 Macadam pavement in said portion of California Street be graded and paved with an Oil lladadam pavement t\'/O (2") inches thick; E.ll of said paving to be constructed to extend from the easterly Ilne of First Avenue to the r:esterly line of Second Avenue. SECTION 2. That the I)rade to which the vlOrk hereinabo','e described shall be done and the improvement made as provided in this Resolution, is sho\nl on Profile and Improvement Plan No. C-158, on file in the office of the City En::;ineer of said City, to which Profile reference is hereby made for the descrj,ption 0:: such e;rade. SECTION 3. All the fore30ing work shall be done in accordance witt. said Pr07ile and Improvement Plan No. C-158 on file in the office of the City En~ineer of said City of Arcadia. All grading, sidewalks, curbs and rrutters shall be in accordance with the follo~ing specifications on file in the office of the City Clerk of said City of lircadia, to-~it: "Standard Specificattons No. 0 for the construction of curbs, sidewalks, gutters, Oil Macadam pavement and concrete pavement". All street paving shall be in accordance with the following specifications on file in t':e 'office of the City Clerk of said City of Arcadia, to-wit: "Standard SpecHications No~ 3, City of Arcadia Specifications for trio (2") inch oil madadam pavement and resurfacinG. II Said Profile and Improveoent Plan No. C-158, and the specifications hereinabove referred to were edopted by Resolution No. 988 of said City Council of the City of Arcadia, and the same are hereby made a part of this ~esolution and are hereby referred to for a more particular descriptIon of said work. -2- All streets and avenues referred to in this Resolution are public streets and avenues of said City of Arcadia. S3CT10N 4. That said contemplated work and irlprovelllent in the opinion of the City Council of said City of Arcadia, is of more than local or ordinary public benefit and said City Council hereby makes tt,e expense of said work and improvement char,ooeable upon the District, which District said City Council hereby declares to be the District benefited by said vork and improvement and to be assessed to pay the costs and expenses thereof, which said District is bounded and described as follo~ls: All that portion of the said City of Arcadia, County of Los An ;eles, state of California, included \nthin the folloving described exterior boundary line, to-wit: Beginning at the intersection of the center line of First Avenue with the uesterly prolongation of the Northerly line of Lot 3, Block 65, Santa Anita Tract, as shovm on map recorded in Book 15, Pages 89 and 90, Uiscellaneous Records of said Los An 'eles County; thence Easterly in a direct line to the intersection of the center line of Second Avenue with the easterly prolon;ation of the northerly line of Lot 18, Block 65, of said Santa Anita Tract; thence Southerly along the center line of Second Avenue to it's intersection with the easterly prolonsatlon of the southerly line of Lot 19, Block 64~, of said Santa Anita Tract; thence westerly in a direct line to the intersection of the centerline of First Avenue with the westerly prolonsation of the Southerly line of Lot 34, Block 64}, of s~id Santa Anita Tract; thence Northerly along the center line of First Avenue to the point of beginning. A Plat or Map of said District i::ldicating by a boundary line the extent of the territory inclwied in the proposed Assessment District, designated as Assessment DIstrict No. 1;1-30, is on file in the office of !laid City EnGineer. Reference is hereby made to the sa:!.d Plat or Hap for a further, :?ull and complete description of said !\ssessment District. TheSaid Plat or llIap so on file shall Govern for all -3- details as to the extent of such Assessment District. SECTION 5. Said City Council also determines and declares that Seri&l Bon1s shall be issued to represent each assessment of Trrenty-Five (025.00) DOllars, or more remainin~ unpaid for thirty (30) days after the date of the ~arrant to represent the expenses of said rrork and improvement. Said Serial Bonds shall extend over a period endin~ nine (9) years from the second day of January next succeedin3 the fifteenth day of the next October followinG their date and an even annual proportion of the principal sum thereof shall be rayable by coupon on the seco'1d day of January, every year after the fifteenth day of the next October folloTIln~ their date, lmtil the whole is paid, and the interest shall be payable semi- annually by cou.pon on the second days of January and July respectively of each year after their date at the rate of six (6%) per cent per annum on all scms unpaid until the whole of said principal and interest are paid. Said Bonds and interest thereon shall be payable at the office cf the City Treasurer of the City of Arcadia. SECTION 6. Notice is hereby given that on Tuesday, the 5th day of September, 1939, at the hour of eiGht o'clock p.m. of said d~~, in the Council Chamber of the City Council of said C~ty of ArcadiE', in the City Hall of said City, any and all persons havin6 any objections to said proposed work or improvement or to the extent of the District to be assessed, or both, may appear before said City Counc:il and sho\'1 cause v!hy said proposed work or improvement should not be carried out in accordance v!1th this Resolution. SECT::ON 1l. All of the proceedin:!s f6r the aforesaid \"lork and improvemen1; and for the issuance of said Bonds shall be had and taken under and in accordance \7i th the provisions of an Act of the Legislature of the State of California, known and desiGnated as the "Improvement Aot of 1911", approved April 7, 1911, and of all Acts supplementary thereto or amendatory thereof. SECTION 8. The Superintendent of Streets shall post or cause to be posted conspicuously along the line of said contemplated work or improv/3ment and also alon:; all the open streets 17ithin the District liable to be assessed and hereinabove described, notices -4- of the pas saSe of this Resolution in the manner and form required by law. SECTIJN 9. The City Clerk shall certify to the adoption of this Resolution and shall cause the same to be published t,I1ce in the Arcadia 'rribune and News, a newspaper of general circulation, published and circulated in the City of Arcadia and hereby desiGnated for that purpos'~; the City Clerk shall also mail not ice of the adoption of this Resolution to all persons owning real property pro- posed to be ass'~ssed, whose names and addresses appear on the last equalized assessment roll for City taxes, or as known to said Clerk. Such notice shall be given in the manner and form required by said "Improvement Act of 1911", approved April 7, 1911, and of all Acts supplementary t~ereto or amendatory thereof.
