RESOLUTION NO, 5088
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARCADIA OPPOSING THE COMPULSORY
AND BINDING ARBITRATION: PEACE OFFICERS
LEGISLATION, AB 187
WHEREAS, AB 187, known as the "Compulsory and Binding Arbitration:
Peace Officers", has been introduced in the 1983 session of the California
Legislature,
WHEREAS, this legislation removes the ability of elected officials
to make their most important budget and service delivery decisions, because
the salary and fringe benefit costs are the major financial items of a budget.
WHEREAS, AB 187 would in essence delegate these budgetary decisions
from the City Council to an outside arbitrator with no accountability to the
voters of a community,
WHEREAS, AB 187 proposes to limit the arbitrator's discretion based
on a list of specified factors. The list included in the Bill is so all-
encompassing that it in essence constitutes no limitation whatsoever on the
arbitrator.
WHEREAS, the practice of compulsory and binding arbitration in
this State and other states had had a detrimental effect upon collective
bargaining to the point that there is very little good faith bargaining,
Under these circumstances there is very little mutual understanding and problem
solving done during the negotiating process, Compromises are not made, The
collective bargaining process ends with binding arbitration.
WHEREAS, AB 187 claims to end strikes; experience has shown there

have been occasions of strikes and slowdowns in response to an arbitrator's
award.

WHEREAS, AB Ib7 disclaims any obligation on the part of the state
to pay for the mandated costs on local government. This disclaimer is not
consistent with rulings of the Legislative Counsel in the past which have
found the cos ts of thl! arbi tra ti on process as well as the cos ts of the
arbitration award above the employer's last offer to be mandated costs for
which the state is responsible,
NOW, THEREFORE, BE IT RESOLVED BY THE City Council of the City of
Arcadia, opposes compulsory and binding arbitration and opposes the passage
of All Ill7,
The City Clerk shall certify to the adoption of this resolution,
