HomeMy WebLinkAbout5093 \\ D Ir RESOLUTIUN NO. 5093 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA GRANTING CONDITIONAL USE PERMIT 83-6 TO OPERATE AN EATING ESTABLISHMENT (BAKERY WITH TABLES) AT 11 EAST FOOTHILL BOULEVARD WHEREAS, on February 14, 1983, Simon G. Zervos filed an application to operate an eating establishment (bakery with tables and chairs) Planning Department Case No. C.U.P. 83-6, on property commonly known as 11 East Foothill Boulevard, more particularly described as follows: Lots 5, 6, 7, and 8, Bloek 1 of Tract 4129 in the City of Arcadia, County of Los Angeles, State of California, as per Map Book 75, Pages 48 and 49. WHEREAS, the Planning Commission approved the Conditional Use Permit to allow 12 tables and 12 chairs, WHEREAS, this deeision was appealed, and WHEREAS, the City Council conducted a public hearing on April 19, 19B3. NOW, THEREFORE, THE CITY COUNCIL does hereby modify the decision of the Planning Commission to approve C.U.P. 83-6 and allow 12 tables and 24 chairs pursuant to the following findings and conditions: SECTION 1. Findings. 1. The granting of this Conditional Use Permit will not be detrimental to the publie health or welfare or injurious to the property of improvements in such zone or vicinity. 2. The use applied for at the location indicated is pro- perly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accomodate said use, and all yards, walls, parking, loading, landscaping and other features required to adjust said use with the l.and and uses in the neighborhood. 4. The site abuts streets and'.highways adequate in width' and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the eomprehensive General Plan. -1- 5093 6. The use applied for will not have a substantial ad- verse impaet on the environment. SECTION 2. Conditions. 1. That plans shall be in substantial compliance with the plans on file in the subject case. 2. That the eating area shall not be enlarged beyond the area shown on the floor plan on file in the Planning Department. Any change in design shall be subject to the review and approval of the Planning Department. 3. That there shall be a maximum of twelve 18" tables with seating not to exceed 24 chairs. 4. That this approval shall not constitute an approval for a general reduction in parking for the total site. That any modification 9ranted for parking shall only be for the use approved by C.U.P. 83-6. That a modification is granted to allow 63 parking spaces in lieu of 93 required. 5. Fire protection shall be provided to the satisfaction of the Fire Department. 6. That C.U.P. 83-6 shall not take effect until the owner and the applicant have executed a form available at the Plannin9 Department indicating awareness and acceptanee of the conditions of approval. -2- 5093 SECTION 3 That the Clerk of the Council shall certify to the adoption of this resolution.
