HomeMy WebLinkAbout5094 \'0 II RESOLUTION NO, 5094 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA APPROVING CONDITIONAL USE PERMIT 83-2 TO ALLOW A CHANGE IN USE OF AN EXISTING TAKEOUT FOOD ESTABLlSHMEln TO AN EAT ItjG ESTABL I SHMENT AT 1002 SOUTH BALDW I N AVEllUE (DBA- ARCADIA DONUT SHOP) WHEREAS, on January 20, 1983. Mr, Guiseppe Angiul i filed an appl ication for an eating establ ishment, Planning Oepartment Case No, C,U,P, 83-2, on property commonly known as 1,002 South Baldwin Avenue, more particularly described as follows: Lot 35 of Tract No, 3h30, in the City of Arcadia, County of Los Anoeles, State Of Cal ifornia, as per Map recorded in Book ~2, Page 32, of Maps in the Office of said County Recorder, WHEREAS. the Planning Commision denied C,U,P, e3-2; and WHEREAS, an appeal to the City Council was filed and a publ ic hearing conducted on AprH 19, 1'!83, concernin" denial of C',U,P, 33-2 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA does hereby reverse the decision of the Planning Commision and grants C,U,P 83-2 pursuant to the following findings and conditions: SECTION 1. FINDINGS 1, That the granting of such Conditional Use permit will not be detrimental to the publ ic health or welfare or injurious to the property or improvements in such zone or vicinity in that the proposed use wi 11 ,not cause insufficient on-site parking. 2, That the use applied for at the location indicated is properly one for which a Conditional Use PErmit is authorized, 3, That the site for the proposed use is adequate in size and shape to accomodate said use, and all yards, spaces, walls, -1- 5094 fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood, 4, That the site abuts streets and highways adequate in width and pavp.ment ty~e to carry the kind of traffic generated by the proposed use, 5, That the granting of such Conditional Use permit will not adversely affect the comprehensive general plan, SECTION 2, CONDITIONS 1, That the eating area(square footage) shall not be enlarged beyond the area shown on the floor plan in the Planning Department, Any change in design shal I be subject to the review and approval of the Planning Department, 2, That there slial.l be a maximum of five rectangular (24r1x36") tables with seating not to exceed twenty chairs, 3, That this approval shall not constitute an approval for a general reduction in parking for the total site, That any modification granted for parking shall only be for the use approved by C,U,P, 83-2, That a modification is granted allowing 33 parking spaces in lieu of 58 spaces required, 4, That the area within the building which is occupied by the business shall maintain a continuous aisle of 36" in width as per the attached Exhibi t "A". 5, That C,U,P.. 83-2 shall not take effect until the owner and appl icant have executed a form avai lable at the Planning Department indicating awareness. and acceptance of the conditions of approval, -2- 5094 SECTION 3 That the Clerk of the Counci I shall certify to the adoption of this resolution, I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the 3rd day of May, 1983 by the affirmative vote of at least three Counc i Imen, to wi t: AYES: NOES: ABSENT: Dring~l.c~ City Clerk of the City cf Arcadia SIGNED AND APPROVED this 3rddayof May, 1983.
