HomeMy WebLinkAbout4247 . .' '. ., . , , RESOLUTION NO. 4247 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ESTABLISHING UNDERGROUND UTILITY DISTRICT NO.5. BE IT RESOLVED by the City Council of the City of Arcadia as follows: WHEREAS, by Resolution No, 4240, a public hearing was called for 7 March 1972, at the hour of 7:30 o'clock p.m., in the Council Chambers in the City Hall, Arcadia, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead struc- tures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service, within that certain area of the City described as follows: That portion of a part of Arcadia Santa Anita Tract, as shown on map recorded in Book 15, pages 89 and 90, of Miscellaneous Records in the Office of the Recorder of Los Angeles County, bounded as follows: On the north by the center line of Wheeler Avenue (shown as Walnut Street on .the map); on the east by the center line of First Avenue; on the south by the center line of Huntington Drive (shown as Falling Leaf Avenue on said map) and on the west by a line that is parallel with and 25 feet west of the center line of Santa Anita Avenue. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. -1- 4247 , . . . ,. ...- r., . . , . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arcadia, that pursuant to Ordinance No, 1375 of the City of Arcadia, the above-described area is hereby declared an underground utility district, and is designated as Underground Utility District No, 5 of the City of Arcadia, RESOLVED, FURTHER, that the City Council does hereby fix 1 November 1972 as the date on which affected property owners must be ready to receive underground service and does hereby order the removal of all poles, overhead wires and associated overhead struc- tures and the underground installation of wires and facilities for SLipplying electric, communication, or similar or associated service within Underground Utility District No.5 on or before 1 January 1973. RESOLVED, FURTHER, that the City Council of the City of Arcadia hereby finds and determines that the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in said area. RESOLVED, FURTHER, that said City Council finds and determines: 1. That the undergrounding to be accomplished pursuant to this resolution will avoid or eliminate an unusually heavy concentration of overhead distribution facilities, 2, The streets, roads, or rights-of-way in said area are extensively llsed by the general public and carry a heavy volume of pedestrian and vehicular traffic. RESOLVED, FURTHER, that the City Clerk, within ten (10) days after the adoption of this resolution, shall mail a copy -2- 4247 . . . " .. , hereof and a copy of Ordinance No. 1375 to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities, The City Clerk shall certify to the adoption of this resolution.
