( ~ 2,154-6/0012a/kl 11/30/84 \j RESOLUTION NO. 5)..03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA CERTIFYING A FINAL ENVIRONMENTAL IMPACT REPORT PREPARED IN CONNECTION WITH THE PROPOSED SALE, DISPOSITION AND DEVELOP~1ENT OF CERTAIN PROPERTY PURSUANT TO THE TERMS OF A DISPOSITION AND DEVELOPMENT AGREEMENT BY AND BETWEEN THE ARCADIA REDEVELOPMENT AGENCY AND DEAN A. BECK AND ASSOCIATES California the City Council of the City of Arcadia, "City Council"), has approved and adopted the Redevelopmen Plan for the Central Redevelopment Project, as amended (the "Redevelo and corporation (the "Developer Plan provides for the property ,located within the Central Redevelopment by qualified developers; and WHEREAS, Dean Associates, a California a proposal to the Arcadia Redevelopment Agency for the acquisition, disposition and development of certa~ real property located near the northeast corner of the intersect~~ of Hum:ington Drive and Second Avenue in the Central Redevelopmen0project (the "Property") "- and the construction and redevelopment thereon of an approximately one hundred and eighty-five thousand (185,000) 'square foot retail " " department store and other commercial building,s, appurtenant Improvements, landscaping and vehicle parking facilities .(the "Project"); and 5203 - 1 - fyrr / / ~ y y , y ( ( WHEREAS, the Agency Staff have prepared an Initial Study of the Project in accordance with the provisions of the California Environmental Quality Act of 1970, as amended ("CEQA"), and based upon said Initial Study, the Agency Staff has caused to be prepared a draft environmental impact ,report (the "Draft EIR") regarding the Project in accordance with CEQA; and WHEREAS, the Draft EIR for the Project has been the subject of public comment and review, including public hearings before the Planning Commiss ion of the City on September 25, 1984, and a pub 1 ic hearing.before the City Council on October 2, 1984, and the impacts upon local street vehicle traffic circulation associated with the" Project, including such cumulative vehicle traffic impacts which may be anticipated to occur if certain other proposed development occurs In the vicinity of the Property, have been the subj ect of thorough Agency Staff and City Staff analysis and public co~ment and review; and WHEREAS, the Agency has caused to be duly published a notice of a public hearing for the receipt and certification of the Final EIR for the Project; and WHEREAS, a Final EIR has been prepared in connection with the Project and submitted for review by the Agency; and WHEREAS, the Agency has requested the City Council approve and certify the Final EIR. 5203 :- 2 - -. . " ( ( NOW, THEREFORE, BE IT RESOLVED, DETERl>lINED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA AS FOLLOWS: Section 1. are true and correct, The f acts described In the recital s hereof Section 2. A full and fair public hearing having been held on the Final EIR prepared in connection with the Project, as stated in the recitals herein, the City Council hereby approves and certifies the Final EIR for the Project as attached hereto as Exhibi t "A" and incorpor ated herein by this reference. The City Council hereby finds and determines that certain changes or alterations in the design of the Project have been required ln or incorporated into the Project which avoid or substantially lessen the significant environmental effects as identified ln the Final EIR. The basis of this finding is that the overall design of the Project has incorporated various mitigation measures which have been recommended following a thorough reVlew of the Project by the Agency, the City and the general public. Specific vehicle traffic mitigation measures have been identified in the Final EIR, including certain vehicle traffic lane restriping on Huntington Drive and the relocation of certain vehicle access points to the Project, Furthermore, the completion of the Project shall implement the Redevelopment Plan, and to the extent that any persons may be di sp laced as a resu1 t of the Proj ect f rom res idences or bus inesses currently located on the Property, suc~ persons shall receive just 5203 - 3 - '. ( ( compensation for their property interest. if any. and certain relocation assistance in accordance with the law or such persons have expressly waived such' relocation assistance in accordance with applicable 1 aw. The Ci ty Counei 1 further finds and determines that wi th respect to the unavoidable adverse environmental effects of the Project, as identified in Section IV of the Final EIR, as follows: (a) That the unavoidable adverse environmental effects -associated with the Project ~ave been considered and recognized by the City Council; and (b) That comments and responses made dur,ing the joint public hearing of the Agency and the City Council concerning the certification of the Final EIR and the approval of the Project have been considered and recognized by the City Council and will be incorporated into the Final EIR; and (c) That based on the information as set forth in ,the Final EIR, the City Council finds and determines that measures to mitigate the effects. as identified in Section I of the Final EIR, exist and are included in the Final EIR; and (d) That as to certain unavoidable adverse environmental .. effects associated '..ith air quality and vehicle traffic effects in the vicinity of the intersection of Huntington Drive and 5203 - 4 - ( r \. Second Avenue the City Council finds and determines that said adverse effects cannot be entirely mitigated by virtue of envi ronmental conditions which are outs ide the jur isdict ion of the City Council and that the extremely high costs associated with any improvement in the current configuration of the railroad separated grade cross1ng at Huntington Drive 1S an economic constraint which makes mitigation measures for such adverse effect infeasible: and (e) That as to the adverse environmental effects associated 'Nith air quality and vehicle traffic impacts at the intersect ion of Huntington Dr ive and Second Avenue, the Agency further finds and determines that there exist overriding considerations so as to permit the City Council to proceed with the Project as described ln the Final ErR. Such overriding considerations are hereby found to be the elimination of blight and the imp1eme~tation of the Redevelopmenc Plan and the beneficial economic and social effects which the approval of the proj ect and the approval of the Final ErR wi 11 have on the Central Redevelopment Project and the City in general. It lS further found and determined that the positive and beneficial effects associaced with the generation of tax increment and certain other revenues to the Agency and the generation of additional sales tax revenues to the City, far out',-,eigh the adverse effects on alr quality and vehicle traffic effects associated with the Project as idencified in the :inal ErR, 5203 - 5 - ( ( The Statement of Overriding Environmental Consideration is attached' hereto as Exhibit "B" and incorporated herein by this reference. Section 3. The City Council hereby further finds and determines that all potential effects on the environment, as identified 1n the Final ErR cannot be entirely or feasibly eliminated and that the beneficial economic and social effects of the Project, override any such potential adverse effects, The Ci ty Staff 1S hereby authorized and direcced 1n cooperation with the Agency Staff to cause a Notice of Determination for the Final ErR to be filed with the Clerk of the County of Los Angeles on December 5, 1984. or as soon thereafter as possible, Section 4, This Resolution shall take effect upon adoption.
