A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, ~
CALIFORNIA, VACATING A PORTION OF CERTAIN AIR RIGHTS OF A PORTION
OF HUNTINGTON DRIVE
RESOLUTION NO. 5210
WHEREAS, the City Council of the City of Arcadia, California, at
its meeting of December 18, 1984, adopted Resolution No. 5206, a Resolution of
the City Council of the City of Arcadia, California, declaring its Intention
to Vacate a Portion of Certain Air Rights of a Portion of Huntington Drive,
and ordered a Public Hearing on this matter to be held on January 8, 1985, and
WHEREAS, a Public Hearing was held in the Council Chambers of the
City of Arcadia at 7:30 o'clock p.m. on January 8, 1985, where any and all
persons interested in or objecting to the proposed vacation of a portion of
certain air rights of a portion of Huntington Drive were heard, and
WHEREAS, the Public Streets, Highways, and Service Easements
Vacation Law provides that the resolution of vacation may provide that the
vacation occurs only after conditions required by the legislative body have
been satisfied and may instruct the Clerk that the resolution of vacation not
be recorded until the conditions have been satisfied.
NOW ,-THEREFORE, THE CITY COUNC I L OF THE CITY - OF ARCAD lA, CALI FORN lA, DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. That the public interest and convenience require, and
based on all ev i dence submitted, that the port i on of the air rights of a
portion of Huntington Drive as further described in Resolution 5206 are
unnecessary for present or prospective public street purposes.
Section 2. That the conditions of approval attached as Exhibit A
and incorporated as part of this Resolution and other conditions that may be
imposed by Motion of the City Council prior to recordation of this Resolution
be completed to the satisfaction of the City Attorney and City Director of
Public Works.
Section 3. Upon completion of the conditions of approval
referenced above, the City Clerk shall cause a certified copy of this
reso 1 ut ion of vacat ion, attested by the Clerk under sea 1, to be recorded in
the office of the County Recorder of the County of Los Angeles.
Section 4. Upon such recordation, the vacation is complete.
