RESOLUTION NO. 5213 OF THE CITY COUNCIL OF THE CITY ESTABLISHING UNDERGROUND UTILITY 10 WHEREAS, the City Council of the City of Arcadia, at its regular meeting of February 19, 19B5, called for a public hearing on March 5, 1985, at the hour of 7:30 o'clock p.m., in the Council Chambers at the City Hall, Arcadia, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service, within that certain area of the City described as follows: That portion, entirely within the City of Arcadia, of a strip of land 140 feet wide lying 80 feet westerly and 60 feet easterly of and parallel to the center line of Baldwin Avenue, beginning at the intersection of the north property 1 ine of Hampton Road and the center line of Baldwin Avenue; thence northerly along the center line of Baldwin Avenue to the northerly boundary of the City of Arcadia. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTIOfl 1. That pursuant to Ordinance No. 1375 of the City of Arcadia, the above-described area is hereby declared an underground utility district and is designated as Underground Utility District No. 10 of the City of Arcadia. -1- 5213 SECTION 2. That the City Council does hereby fix October 31, 1985 as the date on which affected property owners must be ready to receive underground service and does hereby order the removal of all poles, overhead wires, and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service with Underground Utility District No. 10 on or before October 31, 1985. SECTION 3. That the City Council of the City of Arcadia hereby finds and determines that the Public necessity, health, safety, and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service in said area. SECTIOIJ 4. That said City Council finds and determines: 1. That the underground ing to be accomp 1 i shed pursuant to th is resolution will avoid or eliminate an unusually heavy concentration of overhead distribution facilities. 2. The streets, road or right-of-ways in said area are extensively used by the genera 1 pub 1 i c and carry a heavy vo 1 ume of pedestri an and vehicular traffic. SECTION 5. That the City Clerk, within ten (10) days after the adoption of this resolution, shall mail a copy hereof and a copy of Ordinance No. 1375 to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. SECTION 6.
