HomeMy WebLinkAbout4101 RESOLUTION NO. ~ ..;'/0/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 2 BE IT RESOLVED by the City Council of the City of Arcadia as follows: WHEREAS, by Resolution No. 4096, a public hearing was called for 18 November 1969, at the hour of 8:00 o'clock p.m., in the Council Chambers in the City Hall, Arcadia, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service, within that certain area of the City de-. scribed as follows: Live Oak Avenue, 100 feet wide, lying 50 feet to either side of the following described line: Beginning at the intersection of the center line of said Live Oak Avenue and the southerly prolongation of the westerly line of Santa Anita Avenue, as shown on map of Tract No. 11438 filed in Book 234, Page 22 of Maps in the office of the Recorder of Los Angeles County; thence easterly along said center line to the southerly prolongation of the easterly line of Third Avenue as shown on Map of Tract No. 13217 filed in Book 264, Pages 26 and 27 of Maps in the office of said Recorder; and WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard; -1- 5001 '110/ NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arcadia, that, pursuant to Ordinance No. 1375 of the City of Alcadia, the above-described area is hereby declared an Under- ground Utility District, and is designated as Underground Utility District No.2 of the City of Arcadia. RESOLVED, FURTHER, that the City Council does hereby fix 1 September 1970 as the date on which affected property owners must be ready to receive underground service, provided such owners need not prepare for such service if such service is otherwise available to such owners from outside said area, and does hereby order the removal of all poles, overhead wires and associated over- head structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within Underground Utility District No.2 on or before 1 September 1970 ; provided such underground service need not be made available where such service is available to such owners from outside said area. RESOLVED, FURTHER, that the following exception in said Underground Utility District No.2 is hereby authorized: Overhead wires and supporting structures presently located in the north parkway of said Live Oak Avenue and used solely for transmission of 66 KV power need not be removed. RESOLVED, FURTHER, that the City Council of the City of Arcadia hereby finds and determines that the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in said area. -2- ~ <11"1 RESOLVED, FURTHER, that said City Council finds and determines: -. 1. ~rhat the undergrounding to be accomplished pursuant to this Resolution will avoid or eliminate an unusually heavy concentration of overhead distribution facilities. ~ 2. The streets, roads, or rights-of-way in said area are extensively used by the general public and carry 8. heavy volume of pedestrian and vehicular traffic. RESOLVED, FURTHER, that the City Clerk, within ten (10) days after the adoption of this Resolution, shall mail a copy hereof and a copy of Ordinance No. 1375 to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. The City Clerk shall certify to the adoption of this Resolution.
