HomeMy WebLinkAbout4102 o RESOLUTION NO. ~ .y/'" z.-- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 3 BE IT RESOLVED by the City Council of the City of Arcadia as follows: WHEREAS, by Resolution No. 4097, a public hearing was called for 18 November 1969, at the hour of 8:00 o'clock p.m., in the Council Chambers in the City Hall, Arcadia, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, co~unication, or similar or ! associated service, within that certain area of the City described as follows: That portion, entirely within the City of Arcadia, of a strip of land 120 feet wide lying 60 feet each side of and parallel to the center line of Baldwin Avenue, beginning at the intersection of the center lines of Foothill Boulevard and ~ldwin Avenue; thence northerly along the ce~ter line of Baldwin Avenue to the north property line of Hampton Road. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arcadia, that, pursuant to Ordinance No. 13'75 of the -1- .~ 'flo 2-- City of Arcadia, the above-described area is hereby declared an Underground Utility D~strict, and is designated as Underground Utility District No.3 of the City of Arcadia. RESOLVED, FURTHER, that the City Council does hereby fix 1 September 1970 as the date on which affected prop- erty owners must be ready to receive underground service, provided such owners need not prepare for such service if such service is otherwise available to such owners from outside said area, and does hereby order the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within Underground Utility District No.3 on or before 1 September 1970 ; provided such under- ground service need not be made available where such service is available to such owners from outside said area. RESOLVED, FURTHER, that the City Council of the City of Arcadia hereby finds and determines that the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated structures, and the underground im,tallation of wires and facilities for supplying electric., communication, or similar or associated service in said area at no cost to the property owners of the City of Arcadia in or abutting said Under- ground Utility District No.3. RESOLVED, FURTHER, that said City Council finds and determines: 1. That the undergrounding to be accomplished pursuant to this Resolution wrll avoid or eliminate an unusually heavy concentration of overhead distribution facilities. -2- ~ c.j/02_ 2. The streets, raad, ar rights-of-way in said area are extensively used by the general public and carry a heavy volume of pedestrian and ~h'.cular traffic. RESOLVED, FURTHER, that the City Clerk, within ten (10) days after .the adoption of this Resolution, shall mail a copy hereof and a copy of Ordinance No. 1375 to affected property owners as such are shown an the last equalized assessment raIl and to. the affected utilities. . The City Clerk shall certify to. the adoptian of this Resalution.
