HomeMy WebLinkAbout6271 RESOLUTION NO. 6271 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, AMENDING RESOLUTION NO. 6081 RELATING TO THE ESTABLISHMENT OF UNDERGROUND UTILITY DISTRICT NO. 14 WHEREAS City Council Resolution No. 6081, adopted November 3, 1998, established Underground Utility District No. 14, and ordered the removal of all poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication or similar services within the downtown district established by Resolution No. 6081 no later than December 31,2000; and WHEREAS the apparent financial losses in 2000/2001 of the Southern California Edison Company caused by the "Energy Crisis" resulted in the temporary suspension of "underground" utility projects funded by Rule 20A tariffs; and WHEREAS the City Council of the City of Arcadia now proposes to remove Morlan Place from Underground Utility District No. 14 as established by said Resolution No. 6081 because of the uncertainty about future development on and abutting Morlan Place; and WHEREAS Underground Utility District No. 14 created by Resolution No. 6081 in 1 998 was formed under the provisions of California Public Utility Commission decisions which at that time would not allow Rule 20A Funds to be allocated to convert customer meter panels to receive underground service; and WHEREAS the California Public Utility Commission has recently allowed Rule 20A Funds to be used for conversion of customer meter panels from overhead service to underground service; and WHEREAS the City Council of the City of Arcadia, at its regular meeting of December 18,2001, held a public hearing at 7:00 p.m. in the Council Chambers at the City Hall, 240 West Huntington Drive, Arcadia, California, regarding this amendment to City Council Resolution No. 6081; and - 1 - 6271 WHEREAS notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and WHEREAS such hearing has been duly and regularly held, and all persons' interested have been given an opportunity to be heard; and WHEREAS it has been determined that Underground Utility District No. 14 established pursuant to Resolution No. 6081 and amendments thereto as set forth in this Resolution have been determined to be exempt from the California Environmental Quality Act NOW, THEREFORE, THE COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Arcadia hereby amends Resolution No. 6081 by changing the established boundaries of Underground Utility District No. 14 by eliminating from the Underground Utility District No. 14 "Morlan Place" described as follows. Morlan Place Morlan Place, in the City of Arcadia, shown as Morlan Place, Tract 13768, as shown on the map recorded in Book 273, Page 37 of Miscellaneous Record in the Office of the Recorder of Los Angeles County, bounded as follows: On the south by the prolongation of the northerly right-of-way line of Huntington Drive; on the northwest and southeast by the right-of- way lines of Morlan Place; on the east by the prolongation of the westerly right-of- way line of Santa Anita Avenue. SECTION 2. Pursuant to Section 8838 of Ordinance No. 1375, the City Council of the City of Arcadia hereby amends Section 2 of Resolution No. 6081 to extend the date of compliance and to relieve affected property - 2 - 6271 owners of the responsibility of customer meter panel conversions, the amended Section 2 to read as follows: "That the City Council does hereby authorize the expenditure of Rule 20A Funds for the conversion of customer meter panels to receive underground service and does hereby order the removal of all poles, overhead wires, and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar or associated service within Underground Utility District No. 14 on or before March 15, 2003." SECTION 3. The City Clerk within ten (10) days after the adoption of this Resolution, shall mail a copy hereof and a copy of Resolution No. 6081 and of Ordinance No. 1375 to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. The City Clerk shall further notify such affected property owners and affected utility companies of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication, or similar or associated service, they or such occupant shall provide to this City and to applicable utilities, or their agents, a right of entry onto their premises to install facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities. SECTION 4. All findings, determinations, terms and provisions of Resolution No. 6081 not modified by this Resolution are hereby reaffirmed and incorporated herein as if such findings, determinations, terms and provisions were made as of the date of adoption of this Resolution. SECTION 5. That the City Clerk shall certify the adoption of this Resolution. - 3 - 6271 . . . . Passed, approved, and adopted this 18th day of DeceMber . 2001.
