RESOLUTION NO. 6298
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARCADIA, CALIFORNIA, ACCEPTING AN
EASEMENT DEED FROM FOOTHILL TRANSIT TO
THE CITY OF ARCADIA FOR THE RIGHT TO
CONSTRUCT, RECONSTRUCT, MAINTAIN,
OPERATE, AND USE A WATER LINE AND
APPURTENANT STRUCTURES WITHIN CERTAIN
REAL PROPERTY
WHEREAS, Foothill Transit executed an Easement Deed on April 16,2002
(the "Easement Deed"), granting the City of Arcadia an easement for, and the right
to construct, reconstruct, maintain, operate and use a water line and appurtenant
structures in, on, .over, under and across all that real property in the City of
Arcadia, County of Los Angeles, State of California, described in Exhibit "A"
attached hereto and by this reference made a part hereof;. and
WHEREAS, the City of Arcadia is authorized and empowered to accept
from Foothill Transit an easement deed for such purposes; and
WHEREAS, the public interest will be served by acceptanc~ of the
Easement Deed, attached hereto as Exhibit "B."
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
ARCADIA DOES HEREBY FIND, DETERMINE AND RESOLVE AS
FOLLOWS:

SECTION 1.
That the Easement Deed is accepted by and on behalf of
the City of Arcadia for the purposes set forth therein, and the City Manager is
authorized and directed to execute the Certificate of Acceptance attached thereto.
SECTION 2.
That the City Clerk shall certify the adoption of this
Resolution.

LEGAL DESCRIPTION
PARCEL A (A 15 FEET WIDE UTILITY EASEMENT TO THE CITY OF ARCADIA)
That portion of the northwesterly half ofKardashian Avenue (Formerly Myrtle A venue) 50 feet wide
as shown on the map of the Chicago Park Tract, Partly in the City ofhwinda1e and Partly in the City
of Arcadia as per Map Recorded in Book 30 Page 100 of Miscellaneous Records, in the Office of the
County Recorder of Los Angeles County and also that portions of Michigan A venue and Myrtle
Avenue as vacated by Ordinance of the City ofhwinda1e Recorded in Book D-2207 Page 761 of
Official Records of Los Angeles County; within a strip ofland 15 feet wide lying 7.50 feet of each
side of the following described centerline:
Commencing at the centerline intersection of Dearborn Street and Myrtle Avenue as shown on Map
Filed in Book 84 Pages 33 and 34 of Records of Survey, in the Office of the Recorder of the County
of Los Angeles; thence westerly along the centerline of said Dearborn Street N67044'57"W 10.00 feet
to the True Point of Beginning; thence northerly and parallel with the centerline of said Myrtle
Avenue, N22009'45"E 620.10 feet to a line 13.50 feet northerly from the northerly line of said
vacated Michigan Avenue, and also being the northerly line of said Chicago Park Tract; thence
westerly along said parallel line N67044'57"W 1195.22 feet to the easterly line of Peck Road as
shown on said Record of Survey;
The side lines ofthe above described 15 feet wide strip ofland shall be prolonged and
the angle point so as to terminate at their point of intersection.

EASEMENT DEED
For a valuable consideration, receipt of which is hereby acknowledged, the
FOOTHILL TRANSIT, a joint powers authority, does hereby grant to the CITY OF
ARCADIA, a municipal corporation, hereinafter referred to as "City", an easement for,
and the right to construct, reconstruct, maintain, operate and use a water line and
appurtenant structures in, on, over, under and across all that real property in the City of
Arcadia, County of Los Angeles, State of California, described in Exhibit "A" attached
hereto and by this reference made a part hereof.
The location of said easement is shown on the map attached hereto as Exhibit
"B", by this reference made a part hereof.
Together with the right to enter upon and to pass and repass over and along said
easement and right of way and to deposit tools, implements and other materials thereon
by said City, its officers, agents and employees, and by any contractor, its agents and
employees engaged by said City, whenever necessary for the' purposes above set forth.
