RESOLUTION NO. 4358 A RESOLU'l'ION OF THE CITY COUNCIL OF THE CITY OF ARCADIA APPROVING CERTAIN OF THE PLANNING CO~~ISSION'S RECO}~NDEDCHANGES (AS AMENDED BY THE CITY COUNCIL) TO THE PROPOSED REDEVELOPV~NT PLAN FOR THE CENTRAL REDEVELOPMENT PROJECT. WHEREAS, the Arcadia Redevelopment Agency (the "Agency") formulated and prepared the proposed Redevelopment Plan (the "Plan") for the Central Redevelopment Project (the "Project"), and WHEREAS, the proposed Plan was submitted to the Planning Commission and the City Council; .and WHEREAS, the Planning Commission recommended the proposed Plan be changed as set forth in its Report and Recommendation (Planning Commission Resolution No. 823, adopted July 30, 1973); and WHEREAS, after due notice, a joint public hearing was held by the Agency and the City Council to consider the Plan as submitted and as reported on by the Agency and as reported on by the Planning Commission. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARCADIA AS FOLLOWS: SECTION 1. The City Council hereby adopts and approves the changes to the proposed Plan indicated in the att'ached Exhibit "A". SECTION 2. The City Clerk shall certify to the adoption of this Resolution. '~y~ City Clerk (SEAL) -2- 4358 r- EXHIBIT "A" PROPOSED CHANGES TO 'rI-IE PROPOSED REDEVELOPMENT PLAN THE CENTRAL REDEVELOPMENT PROJECT FOR (Additions are underlined; deletions are lined out) PROPOSED CHANGE NO. 1 That a clerical error in line 1 of the first paragraph of 5 301 (page 3) be corrected by substituting therein the word "proposes" for the word "proposed." PROPOSED CHANGE NO. 2 That the third sentence of the second paragraph of 5 310 (page 6) be amended to read as follows: ~ "The Agency shall impose o.n all puJ;:>lic bodies the planning and design controls contained in the Plan to insure that p~eBel'le ~5es-ancl any future development by public bodies will conform to the requirements of this Plan." PROPOSED CHANGE NO. 3 That a new sentence be added after the first sentence of the second paragraph S 311 (page 6) to read as follows: "The Agency shal~also pay to any sch60l district with terri- tory located within the Project area any amounts of money which in the Agency's reasonable2determination is appropriatE to alleviate any finacial burden or detriment caused to any such school district by the project." ,..., lChanged from "may" by City Council minute motion, August 13, 1973. 2"(R)easonable" added by City Council minute motion, August 13, 1973. -1- o f" (""I PROPOSED CHANGE NO. 4 That the first sentence of 5 321 (page 7) be amended to read as follows: "As necessary in carrying out this Plan and only in accor- dance with applicable provisions of the City's Municipal Code, the Agency is authorized to move or to cause to be moved any standard structure or building to a location within or outside the Project area. PROPOSED CHANGE NO. 5 That the first sentence of the third paragraph of 5 325 (pages 8 and 9) be amended to. read as follows: "All property in the Project Area is hereby subject to the restriction that there shall be no discrimination or segregation based upon sex, race, color, religion, national origin, or ancestry, in the sale, lease, sublease, transfer, use, c.::cupancy, tenure, or enjoyment of property in the Project area." ~ROPO&EO CW~NCE NO G item 403 (page 10) to read as follows: "The lly located at the northeast corner of Baldwin Avenue and on the Map as designated for Commercial General use, shall be a regional commercial shopping center; and the uses permitted d the controls and restrictions applied thereto shall be those " 3proposed Change No.6 deleted as an amendment to Res. PROPOSED CHANGE NO.7 '- That the second sentence of 5 404 (page 10) be amended to read as follows: "These industrial uses sha"Il include all those industrial uses permitted by the applicable zone in the Arcadia Municipal Code of-~he-eitYL including but not limited to uses related to research and development facilities." PROPOSED CHANGE NO. 8 That the first sentence of the second ~aragraph of 5 408 (page 11) be amended to read as follows: "In any area in addition to these areas designated on the Map as Open Space and Public Facilities Uses, the Agency is authorized ~ to permit the establishment. and enlargement of public, semi-public, open space, institutional, or nonprofit uses: including civic.cen- ter buildings and facilities; police and fire stations; park ~aee ~Eaek and recreational facilities, hiking and riding trails and facilities; libraries, schools; hospitals; educational, fraternal, employee, philanthropic, and charitable institutions; and facilities of other similar associations or organizations." PROPOSED CHANGE NO. 9 That the first sentence of 5 409 (page 12) be amended to read as follows: "All real property in the projet::t area is hereby subject to the controls and requirements of this Plan ,which controls and r"' requirements shall conform to and not be less than those provided in the City's Municipal Code." -3- '. .' PROPOSED CHANGE NO. 10 That the last paragraph of 5 410 (page 12) be amended as follows: "The Agency shall establish setback, off-street parking, arid off-street loading requirements for all new development within the ~ Project area which may exceed (but shall not be less than) the requirements of the City's zonirig ordinance." PROPOSED CHANGE NO. 11 That a new sentence be added to replace the last sentence of the third paragraph of 5 410 (page 12) to read as follows: "Adjacent properties and adjoining streets shall be shielded from light sources for or in parking spaces." PROPOSED CHANGE NO. 12 That the second sentence of the fourth paragraph of 5 410 (page 12) be amended as follows: "All off-street loading facilities shall be reasonably located at such a depth within a completely enclosed building as to reDson- ("t ably contain and restrict the emission of noise and light typically attributed to such function." ~ PROPOSED CHANGE NO. 13 That a new paragraph be added to replace the second paragraph of S 416 (page 13) to read as follows: "With respect to the amount of open space to be provided in the Project area and with regard to the maintenance of sufficient space between buildings to provide for adequate lig~t, air, and privacy, the requirements and controls of this Plan shall conform to and not be less than those provided in the City's Municipal Code." PROPOSED CHANGE NO. 13A That a new sentence be added after the first sentence of the last paragraph of S 422 (page 15) to read as follows: ,..., "In no event, however" shall the Agency permit a variance which violates any limit, restriction, or control provided in the City's Municipal Code." PROPOSED CHANGE NO. 14 That the first sentence of the first paragraph of S 423 (page 15) be amended to read as follows: "within the limits, restrictions, and controls established in the Plan, the Agency i~-atitheri~ed-~e shall, w~thin 1804days of the adoption of this Plan, establish heights of buildings, land coverage, setback requirements, design criteria, traffic circula- tion, traffic access, .and other development and design controls necessary for proper development of both private and public areas ,..., within the Project area." 4changed from "120" by City Council minute motion, August 13, 1973. -5- r. PROPOSED CHANGE NO. 15 That the word "may" be substituted for the word "will" in the third line of the first paragraph of 5 503 (page IB). PROPOSED CHANGE NO. 16 That item E. under 5 600 (page IB) be deleted. PROPOSED CHANGE NO. 17 That 5 BOO (page 19) be deleted from the Redevelopment Plan, and that the headings "IX. [5.900] PROCEDURE l'OR AMENDMENT" and "X. [5 1000] NEIGHBORHOOD IMPACT ELEl-IENT" be amended to read as follovls: "VIII. [5 BOO] "IX. [5 900] PROCEDURE FOR AMENDMENT" NEIGHBORHOOD IMPACT ELEMENT" ,.... PROPOSED CHANGE NO. 18 That a new sentence be added after the l~st sentence under the provision entitled "Traffic Circulation" of retitled 5 900 to read as follows: "The provision of railroad over- and under-passes will increase vehicular and pedestrian safety while providing for better traffic circulation." PROPOSED CHANGE NO. 19 That a new S 426 be added to the Redevelopment Plan to read as follows: ,...., "J. [3 426] conformity with the f.lunicipal Code Notwithstanding anything provided to the contrary in the -6- r- Plan, all uses/ limits, restrictions, controls, requirements, and c~iteria established in the Plan or by the Agency pursuant to the Plan, shall at least meet the minimum standards provided in the City's Hunicipal Code; and no building permit or plan for the development, construction, or rehabilitation of improvements shall be approved by the Agency which is not in conformity with the City's Hunicipal Code."
