HomeMy WebLinkAbout4377 RESOLUTION NO. 4377 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA AUTHORIZING AN AGREEMENT WITH THE CITY OF MONROVIA FOR A MUTUAL BACKUP PARAMEDIC SERVICE. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: That the Mayor is authorized to execute on behalf of the City of Arcadia an agreement with the City of Monrovia for a backup paramedic service in the form attached hereto. The City Clerk shall certify to the adoption of this resolution. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council Arcadia held on the 2nd day of October of the City of , 19.ry., by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Hage, Helms, Scott and Arth NOES: None ABSENT: Councilman SIGNED AND APPROVED this 2nd day of Oc tober ,1973. {!,,;(> r4J' ~ Mayor of the City of Arcadia ~ST' ~ . 0:1~ C ty Clerk (SEAL) 4377 LO P Y Orf;h A G R E E MEN T This Agreement made and entered into this day of , 1973, by and between the CITY OF ARCADIA, a municipal corporation, and the CITY OF MONROVIA, a municipal corporation; WHEREAS, after the effective date of this Agreement, each city will maintain within its Fire Department a constantly manned, mobile intensive care paramedic unit which will provide emergency medical care within its city boundaries to the sick and injured at the scene of an emergency and during transport to a hospital; and WHEREAS, it is desirable to have a backup paramedic unit available when a city's paramedic unit is already engaged in an emergency; and WHEREAS, each city is capable of rendering to the other a backup paramedic service; NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: 1. In the event that an emergency requiring a paramedic unit exists within the boundaries of one of the cities when the I paramedic unit of that city is already engaged in an emergency, the other city shall deliver the service of its paramedic unit, if not then engaged in an emergency, to said emergency requiring a paramedic unit. 2. The paramedic service rendered hereunder shall not include providing a vehicle for transporting a patient to a hospital. 3. The Fire Chiefs of the parties hereto, acting jointly, shall establish pr0gedures for the administration of ~~ ;~4~~~~ \ this Agreement. Each city shall retain complete jurisdiction and control of its employees rendering service hereunder. 4. This Agreement shall become operative on the date that the paramedic unit of the City of Arcadia is placed in service and shall continue in force until thirty (30) days after either city gives written notice to the other of its intention to terminate. 5. Neither city shall enter into any other agreement which'requires it to provide paramedic service outside its boundaries until thirty (30) days after written notice to the other city of its intention to enter such an agreement. 6. The sole consideration for this Agreement is the mutual agreement expressed herein and neither city shall pay anything to the other for service rendered hereunder. Neither city shall charge anyone for service rendered hereunder. This Agreement is not and shall not be construed as an agreement for the benefit of any third party and shall give no right of action to any person or persons for any cause whatsoever. 7. Pursuant to Government Code 8895.2, it is the intent of the parties hereto that each party shall be responsible for the acts of its own employees, only, and shall protect the other party from any liability for those acts. Therefore, each city shall defend and hold the other harmless from, and indemnify the other for, any loss, cost or expense caused by the negligent or wrongful acts or omissions of its employees occurring in the performance of this Agreement. 8. Each city will fully cooperate with the other and assist in all matters relating to claims arising out of the performance of this Agreement and each will give prompt notification -2- to the other of all occurrences likely to be covered by the terms hereof and if a claim is made or suit is brought to immediately forward copies thereof to the other party. Neither city shall agree, stipulate, consent to or otherwise suffer the granting of any claim, the making of any judgment, order or other award for damages or other relief against itself or any of its employees in any proceeding or action authorized by law involving a matter arising out of the performance of this Agreement, unless the matter involves only the employees of the city taking such action, without the prior written consent of the other city. If either city violates the provisions of the preceding sentence, it shall indemnify, hold harmless and defend the other city from any loss, cost or expense to it arising from such claim, judgment, order or other award, irrespective of the legal basis upon which liability may be imposed by such action, and the other city shall be relieved of and have no obligation under Paragraph 7, above, to defend, hold harmless and indemnify said city violating said provisions of the preceding sentence. 9. Each city shall furnish the other a certificate of insurance showing that its public liability insurance policy is endorsed to name the other city as an additional insured. The insurance afforded to the additional insured shall relate only to operations of the city furnishing the certificate of insurance under this A'gree~ent. The certificate shall also show endorsements in substantially the following form: "(a) The naming of an additional insured as herein provided shall not affect any recovery to which such additional insured would be entitled under this policy if not named as such additional insured." -3- "(b) Any other insurance held by the additional insured shall not be required to contribute anything toward any loss or expense covered by the insurance which is referred to by this certificate."
