HomeMy WebLinkAbout5011 ~ RESOLUTION NO. 5011 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA MAKING CERTAIN FINDINGS WITH RESPECT TO THE CONSIDERATION TO BE RECEIVED BY THE ARCADIA REDEVELOPMENT AGENCY PURSUANT TO CERTAIN DISPO- SITION AND DEVELOPMENT AGREEMENT BY THE ARCADIA REDEVELOPMENT AGENCY WITH HEDRICK ENTERPRISES, INC. FOR THE SALE AND DEVELOPMENT OF SOUTHWEST CORNER OF FIFTH AVENUE AND HUNTINGTON DRIVE IN THE CENTRAL REDEVELOPMENT PROJECT; APPROVING THE PROPOSED SALE OF SAID REAL PROPERTY; AND APPROV- ING THE DISPOSITION AND DEVELOPMENT AGREEMENT PERTAINING THERETO; AND MAKING NECESSARY ENVIRON- MENTAL FINDINGS IN COMPLIANCE WITH LAW. WHEREAS, the Arcadia Redevelopment Agency (the "Agency") is engaged in activities necessary to execute and implement the Redevelopment Plan for the Central Redevelopment Project ("Project"); and WHEREAS, in order to implement the Redevelopment Plan and a pro- po~ed amendment thereto, the Agency proposes to sell various parcels of "Site" in the project area, as described in and pursuant to the terms and provisions of certain Disposition and Development Agreement ("Agreement"); and ", WHEREAS, Hedrick Enterprises, Inc. (the "Developer")' submitted to the Agency a written offer to purchase Agency's parcels and other privately-held parcels comprising Site as described in Agreement; and WHEREAS, Developer possesses the qualifications and financial re~ources necessary to acquire and insure development of the Site, in accordance with the purposes and objectives of the Redevelopment Plan, as amended; and WHEREAS, the Agency has prepared, and the City Council has reviewed and considered, a summary setting forth the cost,of the Agree- ment to the Agency, the estimated value of the interest to be conveyed determined at the highest uses permitted 'under the Redevelopment Plan as amended, and the purchase prices and made said summary available for public inspection in accordance with the California Community Redevelopment Law; and -1- 5011 ~ WHEREAS, the City Council has approved and adopted the Negative Declaration pertaining to the office ; usage contemplated pursuant to said Agreement, sale and development of Site and found and determined that the office usage contemplated pursuant to Agreement will not have a significant effect on the environment or result in a substantial or potentially substantial adverse change in the environment; and WHEREAS, the City Council of the City of Arcadia by its Resolution No. 4924 has adopted and certified a final Environmental Impact Report, a portion of which pertains to office usage of Site: WHEREAS, pursuant to provisions of the California Community Redevelopment Law, the Agency and the City Council held a duly noticed joint public hearing on the proposed sale of the Site and the proposed Agreement; and WHEREAS, the City Council has considered all terms and conditions of the proposed sale, and the redevelopment of the Site pursuant to the proposed Agreement and finds it is in the best interests of the City and the health, safety, morals and welfare of its residents, and in accord with the public purposes and provisions of applicable State and local laws. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL-OF THE CITY OF ARCADIA AS FOLLOWS: 1. The City Council hereby finds and determines that the con- sideration for sale of specified parcels of Site pursuant to the Disposition and Development Agreement between the Agency and Hedrick Enterprises, Inc. is not less than fair market value in accordance with covenants and conditions governinq such sal~. 2. The sale of specified parcels of Site by the Agency to Hedrick Enterprises, Inc. and the Disposition and Development Agreement which establishes the terms and conditions for the sale and development of such Site, are hereby approved. -2- 50ll 3. We hereby certify that we have reviewed and considered the information contained in the Final Environmental Impact Report for the East Huntington Drive Redevelopment Area adopted by Arcadia City Council Resolution No. 4924 for the office and related uses and have reviewed and considered the information contained in the Environmental Impact Report and Negative Declaration referred to in Arcadia Redevelopment Agency ReSOlution ARA-h(and City Council Resolution No. 5010. C __......__----..::.1 ~-. -l 4. We hereby further find and determine as follows, pertaining to the proposed office usage of Site: A. The significant environmental impacts identified in the Final Envi~onmental Impact Report for the East Huntington Drive Redevelop- ment Area (hereinafter refe~red to in this section as EIR) may not be specifically caused by the proposed office usage of Site; however, to the extent such impacts are caused by the proposed office usage, the following mitigating measures will be taken to eliminate such impacts to the extent necessary: (All references herein are to portions of the EIR, and are by thJ.s reference incorporated herein.) 1. The climate/air quality environmental impacts are identified in A2 on page 16 of the EIR. These effects will be mitigated as per Mitigation Measures A3 on pag~ 16. 2. The seismic/geology/soils environmental impacts are identified in B2 on page 19. These effects will be mitigated as per Mitigation Measures B3 on page 20. 3. The water resources/drainage environmental impacts are identified in C2 on pages 20 and 21. These effects will be mitigated as per Mitigation Measures C3 on page 21. 4. The 'biological/botanical environmental impacts are identified in D2 on page 21. These effects will be ,mitigated as per Mitigation Measures D3 on page 21. 5. The archaeological/paleontologic/historic environ- mental impacts are identified in E2 on page 22. These effects will be mitigated as per Mitigation Measures E3 on page 22. 6. The demographic impacts are identified in J2 on pages .33 and 34. There are no mitigating factors identi- fied as being necessary. lO. The transportation and circulation impacts are identified in K2 on pages 36 and 38. The effects will be mitigated as per Mitigation Measures K3 on page 38. 11. The parking impacts are identified in L2 on page 39. The effects will be mitigated as per Mitigation Measures L3 on page 39. ,12. The housing impacts are identified in M2 on page 40. The effects will be mitigated as per Mitigation Measures M3 on page 40. 13. The noise impacts are identified in N2 on page 41. The effects will be mitigated as per Mitigation Measures N3 on page 41. The education impacts are identified in O.8.b on page 49. If relocation of the Continuation High School is required, the City would work with the school district in finding another site. 22. The recreation impacts are identified in O.9~b, on pages 49 and 50. The effects will be mitigated as per Mitiga- tion Measures O.9.c on page 50. 23. The following mitigating measures shall also be taken to the extent they are applicable to the impacts described in this paragraph 4, are: ~) The proposed development will have to comply with the City's zoning and building regulations. ~) The traffic circulation resultant from the proposed project will be subject to the review of the Department of Public Works. 5. We hereby further find and determine that specific economic, social or other overriding considerations, however, make infeasible any mitigation measures not specified in paragraph 4 herein, for any sig- nificant impacts identified in the EIR to the extent caused by office usage of Site and make infeasible project alternatives to office usage identified in the EIR. We hereby find and determine these considerations are as follows: -5- 5011 ,,' A. The development of office usage on the Site will act as a catalyst for future development and will lead toward the rapid and successful implementation of the Arcadia Redevelopment Plan to eliminate blight in the Project area for the protection of the health, safety and welfare of the City of Arcadia. B. Development of the Site with a three-story office facility will substantially enhance the east Huntington Drive gateway to the City and its central business district. C. Development of the site with a 43,000 square foot office .. facility will result in an increase in local employment opportunities by the creation of an estimated one hundred fifty (150) jobs. Q. Development of the Site with a 43,000 square foot office facility will provide commerce opportunities for support retailers within the Central Redevelopment Project Area and throughout the City. 6. That the Clerk of the Council shall certify to the adoption of this resolution.
