RESOLUTION NO. 5013
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA
DECLARING THAT WEEDS GROWING UPON AND IN FRONT OF, AND
BRUSH, RUBBISH, REFUSE, AND DIRT UPON AND IN FRONT OF
CERTAIN PRIVATE PROPERTY IN THE CITY ARE A PUBLIC NUI-
SANCE, AND DECLARING ITS INTENTION TO PROVIDE FOR THE
ABATEMENT THEREOF.
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS:
BE IT RESOLVED THAT, pursuant to the provisions of Articles 1 and 2,
Chapter 13, Part 2, Division 3. Title 4, of the California Government Code,
Sections 39500 to 39588, inclusive, nnd evidence received by it, the City
Council of the City of Arcadia specifically finds:
SECTION 1: That the weeds growing upon the private property herein-
after descri bed and upon the streets and s i de\1a 1 ks in front of sa i d property
are weeds which bear seeds of a wingy or downy nature or attain such large
growth as to become a fire menace to adjacent improved property when dry, or
which are othenl'ise noxious and dangerous.
SECTION 2: That the presence of dry grass, stubble, refuse, or other
flammable materials are conditions which endanger the public safety.
SECTION 3: That by reason of the foregoing facts, the ~Ieeds or dry grass,
stubble, refuse, or other flammable material growing or existing upon the pri-
va te property herei nafter descri bed, and upon the streets and s i del'fa 1 ks in front
of said property constitute a public nuisance and should be abated as such.
SECTION 4: That the private property, together with the streets and side-
walks in front of same herein referred to, is more particularly described as
foll OIl'S, to-wit: That certai n property descri bed in Appendi x "A" attached hereto
and by this reference made a part hereof as though set forth in full at this
point.
BE IT THEREFORE RESOLVED, pursuant to the findings of fact, by this Council
heretofore made, that the weeds or dry grass, stubble, refuse, or other flammable
material in and upon and in front of the real property hereinbefore described
constitute and are hereby declared to be a public nuisance which should be abated.
The Agricultural 'Commissioner, County of Los Angeles, is hereby designated the
person to give notice to destroy said weeds or dry grass, stubble, refuse, or
other flammable material and shall cause notices to be given to each property
OI'1I1er by United States Mail and said notice shall be substantially in the follow-
i ng form to-wit:

"NOTICE TO DESTROY WEEDS
REMOVE BRUSH, RUBBISH, REFUSE, AND DIRT
NOTICE IS HEREBY GIVEN that on January 19, 1982, the City Council of the City
of Arcadia passed a resolution declaring that noxious or dangerous weeds and/or sage-
brush-chaparral were growing upon or in front of the property described in this no-
tice; and/or that rubbish, refuse and dirt were upon or in front of said property on
certain streets in said city or unincorporated area of the County of Los Angeles, and
more particularly described in the resolution, and that they constitute a fire hazard
or public nuisance which must be abated by the removal of said weeds, brush, rubbish,
refuse and dirt, otherwise they may be removed and the nuisance abated by city or
county authorities and the brush, rubbish, refuse and dirt are removed, and such cost
will constitute a lien upon such lots or lands until paid. Reference is hereby made
to said resolution for further details. Herbicides may be used for the prevention of
said weeds. Herbicides may have a residual effect of one year or more. If you are
opposed to the use of herbicides on your property and are willing to be billed the
additional cost of conventional cleaning, please return this post card to the Weed
Abatement Division informing this office of your decision. If you do not return this
card it will be assumed you have no objection to participation in the herbicide pro-
gram. All property owners having any objections to the proposed removal of weeds,
brush, rubbish, refuse and dirt are hereby notified that they may attend a meeting
of the City Counc i 1 of the City of Arcadi a to be hel din the Council Chamber of sa i d
City at 7:30 p.m. on February 16, 1982, when their objections will be heard and given
due consideration. If the property owner does not want to present objections to the
proposed removal of the weeds, brush, rubbish, refuse, and dirt he need not appear
at the above-mentioned hearing.

Property owners are advised that regrowth after first removal should not be
permi tted otherwi se City crews may clear regrowth."
BE IT FURTHER RESOLVED THAT Tuesday, the 16th day of February, 1982 at the hour
of 7:30 p.m. of said day is the day and hour, and the Meeting Room of the City Council
of the City of Arcadia in the City Hall in the City of Arcadia is fixed by this City
Council as the place when and where any and all property owners having any objections
to the aforesaid proposed removal of weeds or dry grass, stubble, refuse, or other
flammable material may appear before the City Council and show cause why said weeds
or dry grass, stubble, refuse or other flammable material should not be removed in
accordance with this resolution, and said objections will then and there be heard and
given due consideration; and .
BE IT RESOLVED THAT the notices to destroy weeds or dry grass, stubble, refuse
or other flammable material hereinbefore referred to shall be mailed by said Agricul-
tural Commissioner at least ten days prior to February 16, 1982.
SECTION 5. That the Clerk of the Council shall certify to the adoption of
this J.esolution.
I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting
of the City Council of the City of Arcadia held on the 19th day of January, 1982,
by the affirmative vote of at least three Councilmen, to wit:
