HomeMy WebLinkAbout5035 RESOLUTION NO. 5035 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA CERTIFYING REVIEW AND CONSIDERATION OF THE FINAL SUPPLEMENTAL AND FINAL ENVIRONMENTAL ;I:MPACT REPORTS FOR THE EAST HUNTINGTON DRIVE REDEVELOPMENT PROJECT AREA, AND MAKING FINDINGS OF OVERRIDING CON- SIDERATIONS RELATING TO, MITIGATION MEASURES AND PROJECT ALTERNATIVES FOR ZONE CHANGE ZSl-5 IMPOSING A HIGH RISE OVERLAY, AND PRECISE PLAN REVIEW PPR Sl-2 FOR DEVELOPMENT OF 333-421 'EAST HUNTINGTON DRIVE. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY RESOLVE, DETERMINE AND FIND AS FOLLOWS: SECTION 1. As the lead and partially responsible agency, we hereby certify that we have reviewed and considered the information contained in the Final Supplemental Environmental Impact Report for the East Huntington Drive Redevelopment Project Area (hereinafter referred to as SEIR) adopted by Arcadia City Council Resolution No. 5032 and pertinent portions of the Final Environmental Impact Report for the East Huntington Drive Redevelopment Project Area (hereinafter referred to as EIR) adopted by Arcadia City Council Resolution No. 4924, prior to approval of ZSl-5 and PPR Sl-2 for development of 333- 421 East Huntington Drive (hereinafter referred to as "Site"), SECTION 2. We hereby further find and determine as follows: A. The significant environmental impacts identified in the SEIR and those portions of the EIR identified below, will be mitigated by the mitigating measures which will be taken to eliminate such impacts to the extent necessary (all references herein are to portions of the SEIR and EIR, and are by this reference incorporated herein) . 1. The Climate/Air Quality environmental impacts are identi- fied in "A" on page 12 of the SEIR. These effects will be mitigated as per Mitigation Measures A3 on page 16 of the EIR. 2,. The Seismic/Geology/Soils environmental impacts are identi- fied in B2 on page 19 of the EIR. These effects will be mitigated as per Mitigation Measures B3 on page 20 of the EIR. -1- 5035 3. The Water Resources/Drainage environmental impacts are identified in C2 on pages 20 and 21 of the EIR. These effects will be mitigated as per Mitigation Measures C3 on page 21 of, the EIR. 4. The Biological/Botanical environmental impacts are identi- fied in D2 on page 21 of the EIR.- These effects will be mitigated as per Mitigation Measures D3 on page 21 of the EIR. 5. The Archaeological/Paleontologic/Historic environmental impacts ~re identified in E2 on page 22 of the EIR. These effects will be mitigated as per Mitigation Measures E3 on page 22 of the EIR. 6. The aesthetic quality impacts are identified in Cl on page 13 of the SEIR. No mitigation measures are required. 7. The shade and shadow impacts are identified in C2 on page 13 of the SEIR. No mitigation measures are required. 8. The light and glare impacts are identified in C3 on page 14 of the SEIR. The effects will be mitigated as per Mitigation Measures identified in C3 on page 14 of the SEIR. 9. The view impacts are identified in C4 on page 14 of the SEIR. No mitigation measures are required. 10. The demographic impacts are identifed in "D" on page 17 of the SEIR. No mitigation measures are required. 11. The transportation and circulation impacts are identified in "E" on page 17 of the SEIR and 3 on page 34 of the SEIR. The effects will be mitigated as per Mitigation Measures identified in "E" of the SEIR. 12. The noise impacts are identified in N2 on page 1 of the EIR and 2 on page 34 of the SEIR. The effects will be mitigated as per Mitigation Measures N3 on page 41 of the EIR and Mitigation Measures in 2 on page 34 of the SEIR. 13. The dust impacts are identified in 2 on page 34 of the SEIR. The effects will be mitigated as per the Mitigation Measure identified in 2 on page 34 of the SEIR. 14'. The Police and Fire impacts are identified in "G" on page 20 of the SEIR. Mitigation measures relative to the Police Department" s concern relative to left turns to and from Huntington Drive are set -2- 5035 forth in the Transportation and Circulation mitigation measures identified in "E" on page 18 of the SEIR. As noted, fire safety is covered by the City's existing Code. 15. The water impacts are identified in "H" on page 20 of the SEIR. No mitigation measures are. required. 16. The sewage disposal impacts are identified in "H" on page 20 of the SEIR. These effects will be mitigated as per Mitigation Measures identified in "H" on page 21 of the SEIR. 17. The solid waste impacts are identified in "H" on page 20 of the SEIR. No mitigation measures are required. 18. The energy supply impacts are identified in "H" on page 20 of the SEIR and 0.6.b on page 47 of the EIR. These effects will be mitigated as per Mitigation Measures identified in 0.6.c on pages 47 and 48 of the EIR. 19. Although traffic impacts from the proposed development are of some concern, they are not large enough to adversely affect traffic flow. The Public Works Department has indicated that a continuous left turn lane may be installed along Huntington Drive between Second Avenue and Fifth Avenue at a later date. Also, a condition of approval for this development is that egress from the site be limited to right turns only at this time. 20. The following mitigating measures shall also be taken to the extent they are applicable to the impacts described in this Section 2, are: a. The proposed development will have to comply with the City's zoning, building, and fire regulations. b. The traffic circulation resultant from the proposed develop- ment will be subject to the review of the Department of Public Works. SECTION 3. We hereby further find and determine that specific economic, social or other overriding considerations, however, make infeasible any mitigation measures not specified in Section 2 herein, for any significant impacts identified in the SEIR and make infeasible project alternatives identified in the SEIR. We hereby find and determine these considerations are as follows: -3- 5035 1. ZSl-5 und PPR Sl-2 will greatly enhance the aesthetic quality of the con~unity and will enable the Arcadia Redevelopment Agency to implement that portion of the Arcadia Redevelopment Plan applicable to site and aid in the elimination of blight in the Project Area for the protection of the health, safety and welfare of the people of the City of Arcadia. 2. Overriding consideration set forth in 3 on page 34 of the SEIR notes that in regard to increased traffic volume on streets with- out sidewalks which might pose a potential hazard to pedestrians, potential mitigation measures include the construction of sidewalks in the area. However, the costs of sidewalk construction at this time make this possibility financially infeasible since the final disposi- tion of North Third Avenue is yet undetermined. Any sidewalks placed in North Third Avenue may have to be removed should portions of the street be vacated to accommodate future development. As the noncon- forming uses are replaced and as the area is developed, sidewalks will be constructed concurrent with these developments. 3. The housing impacts are identified in "F" on page lS and 4 on page 36 of the SEIR. No mitigation measures are required. Over- riding considerations are that at such time as development is proposed for those sites with residential units, relocation will be provided as required by law. 4. The land use environmental impacts are identified in "B" on page l3 of the SEIR. Overriding considerations are set forth in 4 on page 36 of the SEIR. Also, at such time as developments are proposed, relocation will be provided as required by law. 5. Additional mitigation measures to reduce the impact of the proposed development on the nonconforming residential uses are not cost effective in that the nonconforming uses are expected to be phased out as subsequent development occurs in the area. 6. ZSl-5 and PPR Sl-2 will greatly enhance Arcadia's potential as an employment center through increased office opportunities and expand the City of Arcadia's tax base. 7. ZSl-5 and PPR Sl-2 will strengthen the City's tax base by secondary generation of sales tax revenues throughout the City, particularly within the strip-commercial area within the Central Redevelopment Project Area. -4- 5035 \ S. SECTION 5. That the Clerk of the Council shall certify to the adoption of this resolution.
