RESOLUTION NO. 5036
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA APPROVING SUBJECT TO CONDITIONS PRECISE
PLAN REVIEW PPR 81-2 FOR DEVELOPMENT OF 333-421
EAST HUNTINGTON DRIVE AND MAKING FINDINGS OF FACT.
WHEREAS, applicant Robert J. Low filed an application for
Revised Precise Plan Review PPR 81-2 (hereinafter referred to as
PPR 81-2) for a six-story office building at 333-421 East Huntington
Drive;
WHEREAS, the Planning Commission held a duly noticed public
hearing on PPR 81-2 at which time all interested persons were given
full opportunity to be heard and present evidence, and at its February
23, 1982 meeting voted 5-0 with two absent, found that PPR 81-2 for
a six-story office building at 333-421 East Huntington Drive is con-
sistent with the General Plan and adheres to the provisions of the
CPD-l zoning regulations and recommended to the City Council that said
plan should be approved subject to the conditions outlined in the Staff
Report and that the mitigation measures identified in the Environmental
Impact Report be incorporated into the project unless specific findings
of overriding considerations are found.
WHEREAS, on March 16, 1982 the City Council held a duly noticed
public hearing on PPR 81-2 at which time all interested persons were
given full opportunity to be heard and to present evidence.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES
HEREBY RESOLVE, FIND AND DETERMINE AS FOLLOWS:
SECTION 1. That the factual data contained in the Planning
Department Staff Reports and attachments thereto for PPR 81-2 dated
March 16, 1982, and February 23, 1982, is found to be true and correct
and is by this reference incorporated herein.
SECTION 2. That based on aforesaid factual data, we find PPR 8l-2
to be consistent with the General Plan and the City's CPD-l zoning regu-
lations.
SECTION 3. That buildings, structures, signs and landscaping
specified in PPR 81-2 are harmonious with the specific area, and are not
obnoxious, nor undesirable nor unsightly in appearance and are, therefore,

not detrimental to other or existing or planned improvements in the
specified area and are in compliance with the architectural considera-
tions set forth in Title 4, Division 0, Part 6, Chapter 2, Article IX
of the Arcadia Municipal Code, provided all conditions of approval set
forth herein are timely complied with.
SECTION 4. That PPR 81-2 is hereby approved subject to the
following conditions:
A. ThisPPR 81-2 shall become null and void unless the City of
Arcadia vacates and records the resolution of vacation of its easement
across subject site by March 16, 1983.
B. Prior to issuance of a building permit, a parcel map must
be applied for and recorded by applicant consolidating all parcels of
PPR 81-2 prior to issuance of a certificate of occupancy, and applicant
must comply with all conditions of approval of said parcel map, and
prior to issuance of a building permit, applicant must execute a cove-
nant in a form and with content approved by the City Attorney that all
parcels of PPR 81-2 will be held and developed as one parcel.
C. Applicant shall submit a grading and drainage plan for
approval of the Director of Public Works.
D. Applicant shall construct full parkway width Portland cement
concrete sidewalk; replace all deficient and damaged sidewalk.
E. Applicant shall close all driveway openings not to be used,
including existing service road opening opposite Fourth Avenue.
F. Applicant shall plant parkway trees in accordance with City
Standard Plan S-13.
G. Applicant shall provide necessary easements to utility
co~panies.
H. Existing 6-inch sewer lateral, if not to be used, shall be
removed by applicant as directed by the Director of Public Works.
I. That fire safety shall be provided by applicant to the satis-
faction of the Fire Chief.
J. That lighting be provided by applicant in the parking
structure and parking area subject to the approval of the Planning
Department and Police Department.

K. That for security purposes applicant shall maintain a phone
in the parking structure.
L. That the Planning Commission grant a modification to allow
84 small car spaces, a minimum of 8' x 16'.
M. That this PPR 81-2 shall not be effective unless Zone
Change 81-5 is adopted by the City Council.
N. Egress from the easterly driveway shall be restricted to
"right turns" only.
O. That PPR 81-2 shall not take effect until the owner and
applicant have executed a form available at the Planning Department
indicating awareness and acceptance of the conditions of approval.
P. Building height shall be no greater than 85' nor 67.8 ft.
to habitable floor.
Q. Building must comply with 'high rise package' U.B.C. Section

1807, except l807L.
R. Parking structure shall be sprinklered by applicant in accord-
ance with the Arcadia Municipal Code.
S. An additional fire hydrant may be required of applicant by the
Fire Chief.
T. That 28' turning area for fire apparatus shall be provided to
the satisfaction of the Fire Chief.
U. The applicant shall provide a run of the Boyle Engineering
Sewerage System Capacity Model to determine whether additional sewerage
deficiencies will be created by this project. If the test reveals more
system deficiencies resulting from the additon of effluent from the pro-
posed development, said deficiencies must be resolved prior
to issuance of an occupancy permit for the proposed development.
V. That the project shall be developed by applicant in accord-
ance with approved plans on file with the Arcadia Planning Department.
W. That this PPR 81-2 shall become null and void if the H-overlay
zoning is removed from Site.
X. That all mitigation measures specified in the final
Supplemental Impact Report for the East Huntington Drive Redevelopment

Project Area shall be carried out by applicant except those for which
overriding social and economic considerations are specified by Arcadia
City Council Resolution No. 5035 and ARA Resolution No. 66.
Z. That applicant shall enter into an Owner's Participation
Agreement with the Arcadia Redevelopment Agency for development of 333-
421 East Huntington Drive and the same must be recorded before PPR 81-2
or this resolution shall take effect and that PPR 81-2 and this resolu-
tion may be declared null and void by the City Council of the City of
Arcadia should applicant or his assignee default in performance of
said Owner's Participation Agreement that is not cured within the time
limits specified therein.
SECTION 4. If any section, subsection, sentence, clause,
phrase or portion of this resolution is, for any reason, held to
be invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the validity
of the remaining portions of this resolution. The City Council of
the City of Arcadia hereby declares that it would have adopted this
resolution and each section, subsection, sentence, clause, phrase or
portion thereof irrespective of the fact that anyone or more sections,
subsections, sentences, clauses, phrases or portions be declared
invalid or unconstitutional.
