HomeMy WebLinkAbout5037 RESOLUTION NO. 5037 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ADOPTING, AS THE LEAD AGENCY, THE FINAL ENVIRONMENTAL IMPACT REPORT FOR THE SANTA ANITA PLAZA-HOTEL AND OFFICE DEVELOPMENT, AND CERTIFYING ITS PREPARATION IN COMPLIANCE WITH THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, STATE GUIDELINES AND CITY OF ARCADIA RULES IMPLEMENTING THE SAME, AND CERTIFY- ING ITS REVIEW AND CONSIDERATION AND MAKING FINDINGS OF OVERRIDING CONSIDERATIONS RELATING TO MITIGATION MEASURES AND PROJECT ALTERNATIVES FOR ZONE CHANGE Z-8l-6 IMPOSING A HIGH-RISE OVERLAY AND CONDITIONAL USE PE~lIT 81-15 FOR DEVELOPMENT OF 130 WEST HUNTINGTON DRIVE. WHEREAS, duly noticed hearings were conducted in compliance with the California Environmental Quality Act (hereinafter referred to as CEQA) at which time all interested parties present were given an oppor- tunity to be heard and were consulted, including persons owning property and persons in possession of property appertaining thereto, for the purpose of receiving comments to aid in the preparation of a draft "Environmental Impact Report for the Santa Anita Plaza-Hotel and Office Development" (hereinafter referred to as "EIR") by the City of Arcadia's consultant, Donald A. Cotton Associates, for development of 130 West Huntington Drive, Arcadia (hereinafter referred to as "Property"); and WHEREAS, in accordance with the law the City of Arcadia is the lead agency for preparation of the EIR; and WHEREAS, a draft EIR was prepared and a notice of completion was duly filed in accordance with law by the Arcadia Planning Department for zone change &81-6 imposing a high-rise overlay and Conditional Use Permit 81-15, for development of Property which is within the Arcadia Redevelopment Project Area; and WHEREAS, on April 6, 1982 a duly noticed public hearing was con- ducted by this Council on the draft EIR, at which time all interested parties present were given full opportunity to be heard, and said public hearing was continued to April 20, 1982 for the limited purpose of Staff response to comments on the draft EIR; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY RESOLVE, FIND AND DETERMINE AS FOLLOWS: SECTION 1. The "Final" EIR, which is attached hereto as Exhibit A, all written and verbal comments and recommendations and rebuttals -1- 5037 received for the "Final" EIR, the list of persons, organizations and public agencies commenting on the "Final" EIR, and responses to signifi- cant environmental points raised in the review and consultation process, are by t~is reference incorporated herein, and are all hereby adopted as the Final EIR for the Santa Anita Plaza-Hotel and Office Development. SECTION 2. Final EIR has been implementing CEQA, We hereby certify, find and determine that aforesaid completed in compliance with CEQA, the State Guidelines and the City of Arcadia regulations implementing CEQA. SECTION 3. As the lead and responsible agency, we hereby certify that we have reviewed and considered the information contained in the Final EIR prior to approval of ~Sl-6 and CUP Sl-l5 for development of Property. SECTION 4. We hereby further find and determine as follows: A. The significant environmental impacts identified in the EIR will be mitigated by the mitigation measures which will be taken to eliminate such impacts to the extent necessary, as follows (all references herein are to the EIR and are by this reference incorporated herein) : 1. The Land Use environmental impacts are identified in A on pages 13 and 17 of the EIR. No mitigation measures are necessary. 2. The Circulation, Access and Parking impacts are identi- fied in B on pages 20 and 24 of the EIR. These effects will be miti- gated as per Mitigation Measures B on page 24 and Response to Comment #3 on page E-15 of the EIR. 3. The Police and Fire Protection impacts are identified in Cl on page 25 of the EIR. These effects will be mitigated as per Mitigation Measures Cl on pages 25 and 26 of the EIR. 4. The Utilities and Services impacts are identified in C2 on pages 27, 28 and 29 of the EIR. These effects will be mitigated as per Mitigation Measures C2(a)1 on page 29 of the EIR. 5. The Noise impacts are identified in D on pages 32 and 35 of the EIR. These effects will be mitigated as per Mitigation Measures in D on page 35 of the EIR. 6. The following mitigation measure shall also be taken to the extent it is applicable to the impacts described in this Section 2: -2- 5037 the proposed development shall comply with the City's zoning, building and fire regulations. SECTION 5. We hereby further find and determine that specific economic, social or other overriding considerations, however, make infeasible any mitigation measures not specified in Section 4 herein, for any significant impacts identified in the EIR and make infeasible project alternatives identified in the EIR. We hereby find and deter- mine these considerations are as follows: 1. Z-Bl-6 and C.U.P. Sl-15 will greatly enhance the aesthetic quality of the community and will enable the Arcadia Redevelopment Agency to implement that portion of the Arcadia Redevelopment Plan applicable to site and aid in the elimination of blight in the Project Area for the pro- tection of the health, safety and welfare of the people of the City of Arcadia. 2. Overriding considerations set forth in Comment 10 on page E-22 of the EIR notes that in regard to visual impacts as a potential adverse impact, the proposed office and hotel development will alter views of the San Gabriel Mountains from the City Hall and the area of the Arcadia County Park closest to the project site. However, views of the mountains from most of the County Park will not be disturbed or altered. To some extent, views are already blocked by the existing trees, and in summer months, by the region's air quality problems. views of the mountains from residential uses will not be blocked by the proposed pro- ject. 3. The traffic impacts are identified in B on page 20 of the, EIR. As noted on page 24, mitigation measures are directed toward cor- recting design "flaws" in access and internal circulation. The Responses to Comment #1 on page E-l4 of the EIR notes that "the intro- duction of any vehicular surcharge would impact the transportation system." However, based upon parking studies, it is concluded that although additional traffic volumes would result from the project, the volumes are relatively small compared to existing conditions. 4. That the design, heating/cooling/lighting system, water and solid waste suggestions set forth on pages 30 and 31 of the EIR shall be considered in the design and development of the project. How- ever, because the design and construction of an energy efficient project -3- 5037 involves the consideration not only of individual energy saving com- ponents, but of their interaction with one another and because the State has developed comprehensive energy conservation regulations which must be complied with, not all of the suggestions may be ultimately appropriate to be incorporated into the project. Incorporation of all of these sug- gestions would not necessarily be cost effective or energy efficient. The most cost effective and energy efficient project will be secured by requiring compliance with the state's energy cons8rvation regulations. That securing a balance of both cost effectiveness and energy efficiency are conside~ations which override requiring the project to be designed and developed in accordance with all of the suggestions set forth in the EIR. 5. Z-Sl-6 and C.U.P. Sl-l5 will greatly enhance Arcadia's potential as an employment center through increased office and hotel opportunities and expand the City of Arcadia's tax base. 6. Z-Sl-6 and C.U.P. Sl-15 will strengthen the City's tax base by secondary generation of sales tax revenues throughout the City as well as bed tax revenues and sales tax generated by the hotel. 7. Z-Sl-6 and C.U.P. Sl-15 will cause more efficient and desirable land use of limited, available building sites within the City. S. If the subject site were developed under the existing C-2 zoning requirements, a three-story office building containing approxi- mately 250,000 square feet with a three-story parking structure contain- ing 1,000 parking spaces, could be developed on this site, this type of development would be more intense than the proposed high-rise hotel/ office complex. SECTION 6. We hereby adopt as findings of fact all Staff reports on file in the offices of the City Clerk, Planning Department, and Assistant City Manager for Economic Coordination for Z-Sl-6 and C.U.P. Sl-15, and contents of the EIR not heretofore referred to, which are by this reference incorporated herein. SECTION 7. That the Clerk of the Council shall certify to the adoption of this resolution. -4- 5037 I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the 20th day of April, 1982, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Dring, Haltom, Hannah, Lojeski and Pellegrino NOES: None ABSENT: None SIGNED AND APPROVED this 20th day of April, 1982.
