HomeMy WebLinkAbout4713 RESOLUTION NO. 4713 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA APPROVING A NEGATIVE DECLARATION FOR, DECLARING AN INTENT TO FORM SPECIAL AS- SESSMENT DISTRICT 78-1 FOR, AND FINDING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE IN- STALLATION OF A PUBLIC PARKING LOT AT 653 FAIRVIEW AVENUE IN THE CITY OF ARCADIA, AND ACQUISITION OF PROPERTY THEREFORE THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: SECTION 1. That the public interest and necessity re- quire the installation of a public parking lot at 653 Fairview Avenue in the City of Arcadia, hereinafter referred to as "project". SECTION 2. That we hereby approve and file the Negative Declaration for this project and find that it will not have a significant effect on the environment. SECTION 3. That these proceedings and all costs related to this acquisition shall be included within the costs and ex- penses for the formation of a special assessment district herein- after designated as Assessment District 78-l and all of said costs and expenses shall be apportioned and spread pursuant to law. SECTION 4. That in order to expedite a conduct of the proceedings and the formation of said special assessment district, including all land, acquisition monies may be transferred as a loan to a special fund designated "Special Fund - for Assessment District 78-1" in order to pay all costs and expenses prior to the sale of bonds. SECTION 5. That the project is planned and located in the manner which is most compatible with the greatest public good and the least private injury, and the property described herein is necessary for the project. -l- 4713 SECTION 6. The property hereinafter described is to be acquired for public parking purposes, pursuant to California State Constitution Art. I, Section 19 and California Government Code Sections 37353(a) and 54031, and Streets and Highways Code Sections 31506(a), 5023.1(a) and 10102 and California Code of Civil Procedure Sections 1240.010, 1240.l10 and 1240.120. SECTION 7. That aforesaid property heretofore and herein- after referred to as "property" is located in the City of Arcadia, County of Los Angeles, State of California, and is more particu- larly described in Exhibit "A" which is attached hereto and by this reference incorporated herei~. SECTION 8. That the City Attorney of the City of Arcadia is hereby authorized to prepare and prosecute in the name of the City, such proceeding or proceedi~gs in the proper court having jurisdiction thereof, as are necessarY for such acquisition; and to prepare and file such pleadings, documents, briefs, and other instruments, and to make such arguments and generally to take such action as may be necessary in his opinion to acquire for the City fee simple title in and to said property for public use. The City Attorney is specifically authorized to take whatever steps or pro- cedures available to him under the Eminent Domain Law of the State of California contained in Title 7 of the Code of Civil Procedure Chapters 1-12, Sections 1230.010 - 1273.050. SECTION 9. Notice has been sent by first-class mail to each person whose name and address appears on the last equalized county assessment roll for property, advising each person of the intent of the City Council to adopt this resolution and the right to appear and be heard on the matters referred to in California Code of Civil Procedure Section 1240.030, and -2- 4713 SECTION 10. The City Clerk shall certify to the adoption of this resolution. (SEAL) -3- 4713 Property commonly known as 653 Fairview Avenue, in the City of Arcadia, County of Los Angeles, State of California, more particularly described as follows: Beginning at a point in the northerly right-of-way line of Fairview Avenue, per Tract No. 3430 recorded in Book 42, Pa~e 32 of Maps in the Office of the Recorder of said County, said point being fi9 .feet westerly of the southeast corner of Lot I of said tract, said point being the true point of beginning, thence easterly alon~ said northerly right-of-way line to the southeast corner of Lot 1 of said tract, thence northerly along the easterly line of said Lot 1 and its prolongation to the northerly line of the Southern Pac! fie Railroad right-of-way as shown on said tract ma!!, thence westerly along the lost mentioned northerly rir.ht-or-woy line to the BOllth~nAt.
