HomeMy WebLinkAbout4716 RESOLUTION NO. 4716 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA GRANTING LOT SPLIT L-77-16 AND VARIANCE V-77-5 FROM THE LOT WIDTH REQUIRE- MENTS OF THE ZONING CODE UPON AN APPEAL FROM THE PLANNING COMMISSION FOR 102l-l025 SOUTH SIXTH AVENUE WHEREAS, Mr. and Mrs. Thomas Mathews and Mr. and Mrs. Ramon Fauria have duly filed lot split application L-77-16 and Variance V-77-5 for the purpose of splitting one lot into two lots with substandard widths of 69.375 feet at 1021-1025 South Sixth Avenue; and WHEREAS, the Planning Commission denied L-77-16 and V-77-5 for the reasons they would injuriously affect the neighbor- hood and adversely affect the General Plan; and WHEREAS, the applicants have duly filed an appeal from the decision of the Planning Commission, and a public hearing on the appeal has been heard; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA RESOLVES AS FOLLOWS: SECTION 1. That the City Council finds: a. That there are exceptional or extraordinary circum- stances or conditions applicable to the property involved, or to the intended use of the property, that do not apply generally to the property or class of use in the same zone or vicinity. b. That the granting of such variance will not be materi- ally detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity in which the property is located. c. That such variance is necessary for the preservation and enjoyment of a substantial property right of the applicant possessed by other property in the same zone and vicinity. d. That the granting of such variance will not adversely affect the comprehensive General Plan. -1- 4716 e. That the above findings could not be made unless the conditions of approval of V-77-15 are timely complied with. SECTION 2. That, for the foregoing reasons, the City Council grants the appeal of L-77-16 and V-77-5 to permit the SPlitting of one lot into two lots with substandard widths of 69.375 feet wide at 1021-1025 South Sixth Avenue as depicted on Exhibit "A" which is by this reference incorporated herein, subject to compliance with all applicable regulations of the Arcadia Municipal Code and upon the following conditions: a. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. Said report is bV this reference incorporated herein. b. That all structures at 1021 South Sixth Avenue be de- molished and the site cleared by no later than July 17, 1978, and that construction of a new single-family home be commenced bV no later than October 17, 1978 according to plans previously approved by the Planning Department and be completed by no later than April l7, 1979. c. That the structures presently located at 1025 South Sixth Avenue be refurbished according to plans approved by the Planning Department commencing no later than October l7, 1978 and be completed by no later than April 17, 1979. d. That COnditions band c above be completed prior to recordation of the final parcel map for L-17-l6 and that said. recordation shall be made no later than July l7, 1979 unless otherwise approved by this Council. e. That the above described conditions of approval shall be placed in the form of a binding covenant recorded with the County Recorder's office no later than July l7, 1978, in a form and with content approved by the' City Attorney. -2- 4716 BE IT FURTHER RESOLVED that the City Clerk shall certify to the adoption of this Resolution. The preparation and recordation of a parcel map in accordance with the requirements of the State Subdivision Map Act. The map shall be submitted to the County Engineer for checking, and after checking, the County Engineer'a letter recommendin~ approval and map ahall be suhmltted to the City Engineer for map certification. Concurrent with the map hein~ suhmltted to the County Engineer for checking, the applicant should submit a copy of the City's con- ditional requirementa to enable the County Engineer to check for applicable conditions. 2. Fees Required: Final Approval Fee ~p~ $25.00 $10.00 $35.00 The above items are to be complied with to the satisfaction of the Director of Public Works in accordance with applicable provisions of the Arcadia Municipal Code before the final map is recorded. a~Yk#<< CHESTER N.
