HomeMy WebLinkAbout4719 RESOLUTION NO. 4719 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ESTABLISHING UNDERGROUND UTILITY DISTRICf NO. 8 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARCADIA AS FOLLOWS: IHBREAS, the City Council of the City of Arcadia, at its regular meeting of January 3, 1978, called for a public hearing on February 7, 1978, at the hour of 7:30 o'clock p.m., in the Council Chambers at the City Hall, Arcadia, California, to ascer~ tain whether the public necessity, health, safety or welfare re- Quires the removal of poles, overhead wires and associated over- head structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service, within that certain area of the City described as follows: Beginning at the intersection of the westerly line of Bolly Avenue 80 feet wide and the southerly line of Huntington Drive, as same existed on December 1, 1977; thence northerly along said westerly line to a line that is parallel with and distant northerly 25 feet from the northerly line of Huntington Drive; thence westerly along said parallel line through its various courses and distances to its intersection with the northerly prolongation of the easterly line of Baldwin Avenue 95 feet wide; thence southerly along said prolongation to a line that is parallel with and distant southerly 25 feet from the southerly line of Huntington Drive; thence easterly along last said parallel line through its various courses and distances. to the westerly line of Holly Avenue 60 feet wide; thence northerly along last said line to said southerly line; thence westerly along said southerly line to the point of beginning WHEREAS, notice of such hearing has been given to all af- fected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and , within the time required by law; and -1- 4719 WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arcadia, that pursuant to Ordinance No. l375 of the City of Arcadia, the above-described area is hereby declared an under- ground utility district and is designated as Underground Utility District No. 8 of the City of Arcadia. RESOLVED, FURTHER, that the City Council does hereby fix 8/15/78 as the date on which affected property owners must be ready to receive underground service and does hereby order the removal of all poles, overhead wires, and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within Underground Utility District No.8 on or before October 1, 1978. RESOLVED, FURTHER, that the City Council of the City of Arcadia hereby finds and determines that the Public necessity, health, safety, and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service in said area. RESOLVED, FURTHER, that said City Council finds and deter- mines: l. That the undergrounding to be accomplished pursuant to this resolution will avoid or eliminate an unusually heavy concen- tration of overhead distribution facilities. 2. The streets, roads or right-of-ways in said area are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic. 3. The right-of-ways adjoin the Arcadia Fashion Park, the Los Angeles Turf Club, convalescent home, and condominium as well as a portion of the Baldwin Avenue Bus~ness District. RESOLVED FURTHER, that the City Clerk, within ten (10) days -2- 4719 after the adopt10n of this resolution, shall mail a copy hereof and a copy of Ordinance No. 1375 to affected property owners as such are shown on the last equal1zed assessment roll and to the affected ut111t1es. The C1ty Clerk shall certify to the adoption of the re- solut10n.
