HomeMy WebLinkAbout4720 RESOLUTION NO. 4720 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA GRANTING CONDITIONAL USE PERMIT 77-27 FOR A CHURCH UPON AN APPEAL FOR 21 MORLAN PLACE WHEREAS, on October 17, 1977, an application was filed by the Christian Center of Arcadia, Inc., to operate a church Planning Department Case No. C..U.P. 77-27, on property commonly known as 21 Morlan Place, more particularly de~cribed as follows: Portion of Lot 5 of Tract 13768 in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 273, Page 37 of Maps in the office of the County Recorder. ' WHEREAS, the Planning Commission denied C.U.P. 77-27 for lack of access and parking, and inadequate traffic circulation; and WHEREAS, the applicants have duly filed an appeal from the decision of the Planning Commission, and a public hearing on the appeal. has been heard; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA RESOLVES AS FOLLOWS: SECTION 1. That the City Council finds: a. That the granting of such Conditional Use permit will not be detrimental to the public health or welfare. or injurious to the property or improvements in such zone or vicinity. b. That the use applied for at the location indicated is properly one for which a Conditional Use permit is authorized. c. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. d. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. e. That the granting of such Conditional Use permit will not adversely affect the comprehensive general plan. -1- 4720 SECTION 2. That the City Council hereby grants C.U.P. 77-27 for a church at 21 Morlan Place depicted as the shaded area in the map attached hereto as Exhibit "A" and by this reference incorporated herein, subject to compliance with all applicable regulations of the Arcadia Municipal Code and subject to the fol- lowing conditions: 1. Conditions specified in the October 25, 1977 report of the Director of Public Works, attached hereto as Exhibit "B", and by this reference incorporated herein, which conditions shall be complied with to the satisfaction of the Director of Public Works. 2. That all parking, including that at 121-159 North Santa Anita, comply with the following sections: 9269.7.A, 9269.8.A, and 9269.9.A. 3. We hereby find Ohannes R. Berberian and Frances L. Berberian are the existing record owners of 121-159 Santa Anita Avenue and subject property, 21 Morlan Place, which is adjacent thereto. Christian Center of Arcadia, Inc. is the pur- chaser of 21 Morlan Place in escrow. Because 21 Morlan Place con- tains inadequate parking, there shall be recorded with the County Recorder's Office a Covenant running with the land, with content and in a form approved by the City Attorney guaranteeing ingress and egress to 21 Morlan Place from Santa Clara Street across 121- 159 Santa Ani tll, Avenue and guaranteeing the use of all existing, and not less than 20 parking spaces behind 121-159 Santa Anita Avenue, for the benefit of any church use at 21 Morlan Place un- less C.U.P. 77-27 expires pursuant to the provisions of Arcadia Municipal Code Section 9275.2.13 as amended from time to time, in which case the covenant may terminate. Said covenant may restrict parking use of 121-159 North Santa Anita to after the hour of 7:00 p.m. Monday.throu~h Friday and all day on Sunday; however, the right of ingress and egress across 121-159 North Santa Anita shall not be restricted. 4. That a modification be granted for a minimum of 63 parking spaces in lieu of 95 required (including the property at 121-159 N. Santa Anita Avenue). -2- 4720 5. That a parking plan and a landscape a~d irrigation plan identifying planting material, size, spacing and quantity be submitted to the 'Planning Department for its review and approval prior to installation. 6. That a trash enclosure be provided as per Section 9262.6.9 of the Arcadia Municipal Code. 7. That mechanical equipment shall be painted a color which will blend with the roof. 8. Seating at 2l Morlan Place shall be limited to 400 seats in the sanctuary. 9. That no use of the parking spaces at 21 Morlan Place shalY be made for the benefit of any other property witb- out the prior written consent of the Planning Director. SECTION 3. The City Clerk shall certify to the adoption of the resolution. I HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the 7th day of February, 1978, by the affirmative vote of at least three Council Members, to wit: AYES: Council Members Gilb, Lauber, Margett, Parry and Saelid None NOES: ABSENT: None SIGNED AND APPROVED this 7th day of February, 1978. ~. EXHl;Bl;T "A" October 25, 1977 TO: PLANNING DEPARTMENT FROM: DEPARTMENT OF PUBLIC WORKS SUBJECT: C.U.P. 77-27 - 21 MORLAN PLACE The proposed parking lot for this development does not have direct access to Santa Clara Street. Access to Santa Clara Street will be through a,n adjacent parking lot on the east side of this property. Unless the applicant has an easement over the ad10ining property, the access is subject to closure at any time. The following condltiona of approval are recommended: 1. Replace extatln~ asohalt sidewalk and drIve apron on Morlan Place with P.C.C. drive apron and sidewalk. 2.
