OF ARCADIA UPHOLDING THE DECISION OF THE PLANNIWG COMMISSION ON APPEAL AND GRANTING A CONDITIONAL USE PERMIT TO CONSTRUCT A RESTAUR- ANT AT 14 EAST HUNTINGTON DRIVE WHEREAS, on December 6, 1977, an application was filed by Thomas Turiac~ to construct a restaurant, Planning Department Case No. C.U.P. 78-1, on the property commonly known as 14 East Hunting- ton Drive, more particularly described as follows: Lot 31, Block 73, Arcadia Santa Anita Tract, in the City of Arcadia, County of Los Angeles, as recorded in Map Book 15, pages 89 and 90 in the office of the Recorder of said County; and WHEREAS, a public hearing was held by the Planning Commis- sion on January 10, 1978, at which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, the applicant appealed the Planning Commission decision to the City Council to delete the condition that restaurant parking need not .comply with the Arcadia Municipal Code; and WHEREAS, on March 7, 1978, the City Council held a public hearing on said appeal at which time all interested persons were given full opportunity to be heard and present evidence. NOW, THEREFORE; THE, CITY COUNCIL OF THE CITY OF ARCADIA HEREBY RESOLVES AND DETERMINES AS FOLLOWS: SECTION 1. That the factual data submitted by the Planning Department in the attached report is true and correct. SECTION 2. That we hereby sustain the decision of the Planning Commission as set forth in their Resolution No. 103l. SECTION 3. This City Council finds that: l. The granting of conditional use permit as hereinafter provided will not be detrimental to the pUblic health or welfare or injurious to the property or improvements in such zone or Vicinity. -1- 4731 2. The use applied for at the location indicated is pro- perly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use including all yards, parking, load- ing, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of. traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. 6. The use applied for will not have a substantial adverse impact on the environment. SECTION 4. That for the .foregoing reasons, we hereby grant a conditional use permit to construct a restaurant upon the follow- ing conditions: 1. The property.shall be improved arid'm~intained in ac- cordance with the plans which are on file in the subject Case No. C.U.P. 78-l and applicable regulations of the Arcadia MJficipal Code. 2. That parking meet the requirements of the Arcadia Municipal Code. 3. Existing driveway apron not be used shall be closed. One, 15.gallon parkway tree shall be planted at said location sub- ject to the approval of the Director of Public Works. 4. Grading and drainage plan shall be submitted for ap- proval of the Director of Public Works. 5. That the applicant file a covenant approved as to form and content by the City Attorney insuring that the owner of the subject property will participate in a. parking district, should one be formed. 6. That this application be submitted to and approved by the Redevelopment Agency. -2- 4731 7. That final architectural plans be submitted to and approved by the Planning Depart~ent. I SECTION 5. The City Clerk shall certify to the adoPti~n of this resolution.
