HomeMy WebLinkAbout4734 RESOLUTION NO. 4734 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA DENYING M-78-1 UPON APPEAL FROM THE PLANNING COMMISSION AND MODIFICATION COMMITTEE ' WHEREAS, on January 24, 1978, the Modification Committee , reviewed and denied M-78-1 filed by Mrs. Slava Starr for her property at 843 South Golden West Avenue, Arcadia, hereinafter reterred to as "subject property" on the grounds subject property is too small to support the proper development of a second re- sidential unit. WHEREAS, on appeal to the Planning Commission, the deci- sion of t~e Modification Committee was upheld and M-78-1 was denied after a duly noticed pUblic hearing; and WHEREAS, the applicant appealed the decision of the Planning Commission to the Arcadia City Council and a duly noticed public hearing was held on said appeal before the City Council on March 21, 1978 at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY RESOLVE AND DETERMINE AS FOLLOWS: SECTION 1. That we hereby make the following findings of fact: APPLICANT: Mrs. Slava Starr (owner) LOCATION: 843 South Golden West Avenue REQUEST: To appeal the Planning Commission's denial of the following modifications: 1. A 8' side yard setback for an existing house and a 6' side yard setback for a proposed multi-family addition in lieu of the 10' minimum setback required by Arcadia Municipal Code Section 9255.2.4. - 1 - 4734 LOT AREA: FRONTAGE: GENERAL PLAN: ZONING: SURROUNDING ZONING AND LAND USE: 2. Three parking spaces for two dwelling units (one existing, one proposed) in lieu of a minimum of four parking spaces required.by Arcadia Municipal Code Section 9255.2.9) 3. A proposed driveway to occupy 68.3% .of the required front yard in lieu of the 25% maximum coverage allowed by Ordinance 1604. 4. A 2'6" wide landscaped buffer between a pro- posed open parking space and the property line in lieu of the 5' wide landscaped buffer required by Arcadia Municipal Code Section 9255.2.9. 5,600 square feet 40' on Golden West Avenue Multiple Family Residential 7+ dwelling units per acre R-3 (Multiple-Family) North: R-3 Single and Multi-Family East: R-3 Single and Multi-Family South: R-3 Single and Multi-Family West: R-3 Multi-Family (see land use and zoning map) The applicant proposes to add a dwelling unit to the existing single-family house, thus converting it into a multi-family building. The code requires that the existing portion of a pro- posed multi-family building must be reconstructed to meet all present R-3 building requirements. The applicant was informed of this at the Modification Committee meeting and her architect has been given a copy of Arcadia's amendments to the R-3 build- ing regulations. The owner of the neighboring property at 835 and 839 South Golden West objected to the granting of M-78-1. Subject property is too small to support a second residential unit. There is a parking deficiency in the neighborhood of subject pro- perty and waiver of the parking requirements would compound this deficiency as well as force a fourth car to park tandem on the property extending into the 25 feet front yard setback in viola- tion of the code. - 2 - 4734 That when applicant purchased said property, all of the zoning requirements applicant is seeking a modification from were in effect except Ordinance 1604. That the modification request from the driveway coverage require- ment is too extreme. The land use and zoning map and site plan attached hereto as Exhibit "A" are true and correct and are by this reference ,in- corporated herein. That M-78-l would not provide an appropriate improvement nor pro- mote uniformity of development, nor is it necessary to prevent an unreasonable hardship. SECTION 2. Based on the above-described findings, the decision of the Arcadia Planning Commission is upheld'arid M-78-1 is hereby denied. SECTION 3. The Clerk of the Council shall certify to the adoption of this resolution.
