RESOLUTION NO. 4745
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA UPHOLDING THE DECISION OF THE PLANNING
COMMISSION ON APPEAL AND DENYING M78-35 FOR 2637
SOUTH LOUISE AVENUE.
WHEREAS, on March 28, 1978 the Planning Commission, 6 to 0,
after a duly noticed public hearing at which all interested per-
sons were allowed to be heard, denied M78-37 filed by Robert S.
Metz, hereinafter referred to as "applicant", owner in escrow of
2637 South Louise Avenue (Lot 8 of Tract 11438), hereinafter
referred to as "subject property", on the grounds that develop-
ment of Lot 8 separate from Lot 9 in aforesaid Tract, would make
Lot 9 into a commercial site fronting on a residential street,
Louise Avenue;
WHEREAS, the Planning Commission also directed Staff to
initiate a zone change on Lot 9 from commercial to residential;
WHEREAS, the applicant appealed the denial of M78-38 by the
Planning Commission to the Arcadia City Council and a duly noticed
public hearing was held on said appeal before the City Council on
May 2, 1978 at which time all interested persons w~re given full
opportunity to be heard and to present evidence;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES
HEREBY RESOLVE, FIND AND DETERMINE AS FOLLOWS:
SECTION 1. That the March 28, 1978 Staff Report is true and
correct.
SECTION 2. That the applicant has requested the following:
a. To develop an office building on Lot 8 of Tract
ll438 in lieu of developing Lots 8 and 9 as one
building site as required by Ordinance l18l.
b. Vehicular access from Live Oak Avenue for a proposed
office building. Said vehicular access is prohibited
by Ordinance 1181.

c. A 10' building setback from the Live Oak property
line for a proposed office building in lieu of the
50' minimum setback required by Code Section 9320.50.2.
d. A 10' rear yard setback for a proposed office building
in lieu of the 30' minimum setback required by Code
Section 9261.2.4.
SECTION 3. That approval of M78-38 would create a commercial
site (Lot 9) which would front on a residential street, Louise
Avenue, contradictory to the intent of the original zone change
and contradictory to good zoning practice in that it would prohibit
the commercial development of Lot 9 in accordance with its zoning
designation of C-O & D.
SECTION 4. That M78-35 is not necessary to secure an appropriate
improvement, or to prevent an unreasonable hardship or to promote
uniformity of development.
