RESOLUTION NO. 4551
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARCADIA ESTABLISHING PROCEDURE
FOR NOTICE AND APPEAL PROVIDED IN THE
PROPERTY MAINTENANCE ORDINANCE
WHEREAS, Sections 9407 and 9409 of the Arcadia Municipal
Code require that certain procedures relating to notice and
appeal as provided in the Property Maintenance Order shall be
established by resolution;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The notice and order of the Building Official
may be given either by personal delivery thereof to the record
owner of the property affected, or by deposit thereof in the
United States mail, in a sealed envelope, postage prepaid,
addressed to the record owner of the property, at his last known
business or residence address as the same appears in the assess-
ment rolls of the City or of the County.
SECTION 2. The written notice of appeal shall state the
grounds and sufficient factual data upon which the appellant
relies in his appeal from the notice and order of the Building
Official and shall be filed with the City Clerk within
thirty (30) days from the date of the notice and order.
Upon receipt of the notice of appeal, the City Clerk shall
forthwith notify the Building Official of such appeal and
shall schedule such appeal to be heard by' the City Council at

its first regular meeting held fifteen or more days after the
filing of such notice of appeal. Such hearing may be continued
from time to time for good cause.
SECTION 3. Upon the hearing of the appeal, appellant
shall be given a reasonable opportunity to present evidence,
both oral and documentary, including witnesses in his behalf,

to justify his objections to such notice and order. The
Building Official shall be given a reasonable opportunity to
present similar evidence to support the notice and order in
question. At the conclusion of the hearing of any such appeal,
the City Council shall, by a vote of the majority of its mem-
bers entered upon the Council minutes, affirm, modify or
reverse the notice and order issued by the Building Official,
and such action by the Council shall be final. The time limits
in the notice and order for corrective action shall be extended
by the number'of days during which the appeal is pending.
SECTION 4. The City Clerk shall certify to the adoption
of this resolution.
