HomeMy WebLinkAbout4554 " RESOLUTION NO. 4554 CITY OF ARCADIA RESOLUTION OF THE CITY COUNCIL COVERING PRELIMINARY DETERMINATION THAT THE PUBLIC CONVENIENCE AND NECES- SITY REQUIRES CERTAIN ACQUISITION AND IMPROVEMENTS IN AN ASSESSMENT DISTRICT AND, S~TTING ^ TIME AND PL~CE FOR HEARING TH~REON. . ASSESSMENT DISTRICT NO. 76-1 (CENTRAL AREA STREET AND PARKING IMPROVEMENTS) WHEREAS, Section 17 of Article XIII of the Constitution of the State of California provides that the debt limitation and majority protest provisions of said Section 17 shall not apPlY if, after giving of reasonable notice by publication and posting and the holding Of a public hearing as the City Council shall h~ve prescribed, said City Council, by not less than four-fifths (4/5) vote of all members thereof, finds and determines that the pUblic convenience and necessity require the improvements and acquisition, where necessary, in a special assessment district in said City .~noWn and designated as ASSESSMENT DISTRICT NO. 76-l (CENTRAL AREA STREET AND PARKING IMPROVEMENTS) (hereinafter referred to as the "Asse::>sment District"); and, WHEREAS, Section 2804 of the Streets and Highways Code of the State of California provides that the "special Assessment Investigation, Limitation and Majority Protest Act of 1931"s~all not apply to any proceedings otherwise Subject thereto when said improvement proceedings are by a charter city and said city has complied with the provisions of Section 17, Article XIII of the Constitution of the State of Califprnia; and, WHEREAS, this City is a charter city.of the State of Californii:\. OF THE NOW, THEREFORE, IT IS HEREBY RESOLVED BX. T~E CITY COUNCIL q:TY OF ARCADIA 1\S FOLLOWS: SECTION 1. That the above recitals are all true and con'ect. SECTION 2. That it is the preliminary determination of this City Council that the public convenience and necessity require certain public works of improvement, including' acquisition, where necessary, within the Assessment District. For further particulars reference is hereby made to Exhibit "A", attached hereto and made a part hereof which describes said works of improvements. SECTION 3. That certain costs and expenses of said acquisition and improvement shall be assessed against the lands benefited thereby, and the boundaries of the district of lands pro- posed to be assessed to pay the costs and expenses of said pro- posed acquisition and improvement are shown upon a map of the District, said map entitled: "PROPOSED BOUNDARIES OF ASSESSMENT DISTRICT NO. 76-l (CENTRAL AREA STREET AND PARKING IMPROVEMENTS) and, hereto approved and adopted by the City Council and a copy of which is on file in the office of ~he City Clerk of this qity and referenced for further partiCulars. ' SECTION 4. NOTICE IS HE~EBY GIVEN THAT ON TUESDAY THE 4th DAY OF MAY, 1976 , AT THE HOUR OF 7: 30 PM IN THE COUNCIL CHAMBERS OF THE CITY COUNCIL OF THIS CITY, THERE SHALL BE A PUBLIC HEARING BEFORE THE CITY COUNCIL FOR THE PURPOSE OF DETERMINING WHETHER OR NOT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE ABO~ DESCRIBED IMPROVEMENT ~D ACQUISITION. SECTION 5. That the Citr Clerk shal~ publish this Resolu- tion ~n the "ARCADIA TRIBUNE" a newspaper of general circulation in said City on two successive dates, the first pUblication to be made not less than ten (10) da~s prior to the date of the above sCheduleq Publ~c Heari~g. SECTION 6. That the City Clerk is hereby directed to cause Notice of said hearing to be posted along the line of the contemplated work and on all open streets within the Assessment District at not more than three hundred (300) feet in distance apart On eacbstreet so posted. SECTION 7. That the City Clerk is hereby further directed to mail Notices of said hearing to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for the City taxes, said mailing to be completed at least tifteen (15) days prior to the date set far' the Public Hearing. EXHIBIT "A" CITY OF ARCADIA ASSESSMENT DISTRICT NO. (CENTRAL AREA STREET -AND -PAR'KING 76-1 ----- -- IMPROVEMENTS) DESCRIPTION OF THE WORKS OF IMPROVEMENT AND ACQUISITION 1. The construction of certain parking area improvements, including paving, lighting and ornamental vegetation, together with all appurtenances and appurtenant work in connection therewith, with- in the boundaries of the Assessment District, generally at the points and places as shown on the map attached hereto. 2. The acquisition of all necessary land, area and rights- of-way for the parking area improvements, where necessary, to accom- plish the improvements as set forth above and generally at the points and places as shown on the map attached hereto. 3. The construction of certain alley improvements, to- gether with appurtenances and appurtenant work in connection there- with in the alleys at the points and places, further as shown on the map attached hereto. '4. The acquisition of necessary alley rights-of-way to widen the first alley northerly of Huntington Drive and for further particulars, reference is herebr made to the map attached hereto. For all further particulars, reference is made to the proposed boundary map, as previously adopted by the City Council, showing the general nature, location and extent of the works of improvement. The descriptions and extent of the works of improve- ment and acquisition, as shown on this map, are general in their nature and, upon final determination of the City' Council as to whether or not to proceed with the works of improvement and the acquisitions, detailed plans and specifications will be prepared and presented to this City Council for their consideration and approval. 4554 STATE OF CALIFORNIA COUNTY OF LOS ANGELES CITY or ARCADIA" . ss.
