RESOLUTION NO. 4585
A RESOLUTION OF THE CITY COUNCIL O~ THE
CITY OF ARCADIA AUTHORIZING THE PURCHASE
OF CERTAIN PROPERTY AT 542 FAIRVIEW
AVENUE, CITY OF ARCADIA, CALIFORNIA
FOR PARK PURPOSES
WHEREAS, the City of Arcadia has, for some considerable
time, been interested in purchasing the hereinafter described
real property for park purposes; and
WHEREAS, the property is presently being offered for sale
by N. Christian Datwyler and Sally S. Datwyler;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ARCADIA that the purchase of said property by the City
of Arcadia is hereby authorized, and the agreement attached hereto
as Exhibit "A" between the City of Arcadia and N. Christian and
Sally S. Datwyler is hereby approved and ratified, and the
Director of Public Works' execution of aforesaid agreement is
hereby approved and ratified.
BE IT FURTHER RESOLVED that the Director of Public Works
is authorized to execute any additional documents necessary to
obtaining legal title to said property.

PURCI~SE AGREE~lliNT
IT IS AGREED between the CITY OF ARCADIA, a Municipal, Corporation, herein
referred to as "Purchaser" and N. ClffiISTIAN DATWYLER AND SALLY S. DATWYLER,
husband and wife, herein collectively referred to as "Sellers" shall sell and
Purchaser shall buy the hereinafter described real property on the following
terms and conditions:
1. Sellers shall execute and deliver, a grant deed of said property'
to the Purchaser at which time Purchaser shall take possession of said property
which deed shall be recorded by a title company, selected by the Purchaser, when
said title company can issue and deliver its policy of title insurance in the
amount of $110,000 to the Purchaser showing title vested in the Purchaser free
and clear of all encumbrances.
2. Current taxes shall be prorated to the date of recording of said deed.
3. When the deed is recorded, the Purchaser shall pay to Sellers the sum
of $10,000 and the balance of $100,000 shall be paid on or before 120 days from
the effective date of this agreement less any amount for prorated taxes pursuant
to Paragraph 2.
4. Sellers shall execute any documents required by the title company
in order to issue said 'policy of insurance.
5. Purchasers shall pay the cost of the title policy and ordinary expenses
of transferring title, if any.
6. Said property is connnonly known as 51,2 FairvJ.ew Avenue, in the City of
Arcadia, County of Los Angeles, State of California, more particularly described
-r as follows:
The West 95.19 feet measured along the 'North and South lines of Lot 30,
Tract No. 3430 as shown in Book 42, Page 32 of Maps in the Office of
the Recorder of Los Angeles County.
