HomeMy WebLinkAbout4652 RESOLUTION NO. 4652 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA MAKING FINDINGS OF FACT AND DENYING CONDITIONAL USE PERMIT 77-12 FOR A SKATEBOARD PARK AT 131-137 EAST LIVE OAK AVENUE WHEREAS, On June 20, 1977, an application was filed by Robert G. Margett to operate a recreational facility for skateboarding, Planning Department Case No. CUP 77-12, on property commonly known as 131-137 East Live Oak Avenue, more particularly described as follows: Lots 1 and 43, Tract No. 12915, in the City of Arcadia, County of Los Angeles, as shown on map recorded in Book 270, page 10, of Maps, as re- corded in the office of the Recorder of said County WHEREAS, the Planning Commission held a public hear- ing on July 12, 1977 on said matter, at which time all interested persons were given full opportunity to be heard and to present evidence, and by a 6-1 vote, the Planning Commission approved; WHEREAS, an appeal of the Planning Commission's de- cision was filed by Dr. Ben Mirman, representing the occupants of the Green Oaks Medical Building at 115-117 East Live Oak Avenue, immediately ad~acent to subject site, who has alleged receipt of no notice of the Planning Commission's public hear- ing, though notice was duly and legally given; WHEREAS, on August 16, 1977, a public hearing was held py the City Council on aforesaid appeal at which time all in- terested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY RESOLVE AND DETERMINE AS FOLLOWS: -1- 4652 SECTION 1. That we hereby make the following findings of fact: 1. That the proposed use will generate a large amount of pedes- trian and vehicular traffic. 2. Residents and owners of businesses adjacent to and in the vicinity of subject property are opposed to the proposed use because of increased noise from motor vehicles, and traffic congestion in the alley behind the proposed facility. 3. Traffic to and from the facility would ingress and egress on Greenfield Street, a long deadend cul-de-sac which has speed- ing traffic which often stops suddenly. 4. Traffic congestion already exists at or near subject site. 5. The proposed site is unappropriate for skateboard park use due to its small size in relation to other existing skate- board pa.rks and due to its location immediately adjacent to established residential and commercial uses. 6, That the granting of the permit would be detrimental to the public health or welfare or injurious to the property or improvements in its zone or vicinity. SECTION 2. Based on the foregoing findings of fact, we hereby overrule the decision of the Planning Commission and deny the application for Conditional Use Permit 77-12. SECTION 3. The City Clerk shall certify to the adoption of this resolution.
