HomeMy WebLinkAbout4677 RESOLUTION NO. 4677 RESOLUTION OF THE CITY COUNCIL ORDERING CERTAIN CHN,GES AND MODIFICATIONS IN PROCEEDINGS AND ASSESSMENTS IN AN ASSESSMENT DISTRICT PURSUANT TO THE "MUNICIPAL IMPROVEMENT ACT OF 1913", BEING DIVISION 12 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA. CITY OF ARCADIA WHEREAS, this City Council did, on the 20th day of SEPTEtlliER, 1977 , adopt its Resolution of Intention pursuant to the provisions of the "Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the State of California for the construction of certain public works of improvement in a special assessment district known and desig- nated as ASSESSMENT DISTRICT NO. 76-1 (CENTRAL AREA STREET AND PARKING HIPROVEMENTS) (hereinafter Teferred to as the "Assessment District"); and; WHEREAS, subsequent ,thereto, thi.s City Council did, by Resolution, approve the "Report" and call for sealed bids on the construction of the works of improvement as contemplated in said Assessment District; and, WHEREAS, prior to said Public Hearing, sealed bids were received and considered for the construction of the works of improve- ment in the Assessment District, and based on the recommendations therefor, it is now determined that assessments can be amended and modified because of the favorable construction bid ~o rec~ived; and, WHEREAS, it now appears to this City Council that certain changes and modifications should be considered in the "Rep6rt" and assessments for the Assessment District. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF ARCADIA CALIFORNIA, AS FOLLOI"S: SECTION I. That the above recitals are all true and correct. SECTION 2. That it is in the best public interest and convenience that assessments be modified, amended and reduced as set forth on Exhibit "A", attached hereto and made a part hereof, and said City Council does hereby order the proceedings, the "Report" and the assessment roll to be modified and amended to reflect the amendments as set forth in said Exhibit "A". SECTION 3. That said changes and modifications above- mentioned are hereby ordered pursuant to the authority as set forth in Section'10352 of the Streets and Highways Code of the State of California (Municipal Improvement Act of 1913). I SECTION 4. That the Superintendent of Streets is hereby ordered to make the above-listed corrections and modifications for the assessment roll, and the assessments as set forth in the "Report" prev{ouslyapproved. SECTION 5. That the Engineer's Report, the Asse~sment Roll and all related documentation, as so modified, are all for the best interests of the property owners within the Assessment District, and said assessment, as modified and apportioned, is in accordance with the benefits received and the "Report", as herein modified and amended, shall now stand as the "Report" for all subsequent proceedings relating to this Assessment District. Based on the favorable construction bids received, the assessments and cost o~ construction can be reduced as set forth below, and it is hereby ordered that all assessments be modified and reduced based on the results from the bidding on the works of improvement. II. At this time, this City Council declares its intention and so orders and appropriates an increase in the contribution from the figure as set forth in the Engineer's "Report" of $65,771.00 to a figure of $83,771.00. Said figure repre- sents the final land acquisition cost as set forth in said Engineer's "Report" for this Assessment District. For par- ticulars, reference is made to the Engineer's "Report" for the final quantities and costs for, the works of improvement, and also for a detailed explanation as to the final contri- bution as herein appropriated and so ordered by this City Council. The final confirmed costs shall be as follows: As Preliminarily Approved As Confirmed and Recorded Cost of Construction: $ 156,129.00 .s 146,097.20 Contingencies: 23,419.00 7,305.80 44,352.00 Incidental Expenses: 44,409.00 Land Acquisition Cost: 18,000.00 ~ooo.oo 215,755.00 83/771.00 .~, TOTA.L COST: ~ 241,957-.00 70,201. 00 Estimated Contribution: TOTAL ASSESSABLE COST: 171,756.00 131,984.00 The above costs shall be redistributed and spread in direct pro- portion to the benefits received under the same basis ann formula as originally set forth in the Engineer's "Report" for these pro- ceedings for this Assessment District. . EXHIBIT "A" CITY OF ARCADIA PAGE TWO III. It is hereby determined to be in the best public interest and convenience, by reason of the size of the proposed bond issue for this Assessment District, to provide that said bonds shall extend over a TWENTY YEAR term, and the Resolution of Intention for said proceedings did provide that the bonds to be issued to finance said improvements pursuant to the provisions of the "Improvement Bond Act of 1915" shall mature a maximum of and not to exceed TWENTY FOUR YEARS from the 2nd day of July next succeeding ten (10) months following their date. Section 4 of the, Resolution of Intention, entitled "BONDS", shall now read as follows: BONDS "SECTION 4. Notice is hereby given that serial bonds to represent,the unpaid assessments, and bear interest at the rate of not to exceed Eight Percent (8%) per annum, will be issued hereunder in the manner provided in the "Improvement Bond Act of 1915", being Division 10 of the Streets and Highways Code of the State of California, the last installment of which bonds shall mature a maximum of and not to exceed NINETEEN years from the 2nd day of July next succeeding ten (10) months from their date. The pro- visions of Part 11.1 of said Act, providing an alternative procedure for the advance payment of assessments and the ca~ling of bonds shall ,apply." The provision for the bonds to be payable' in twenty (20) annual installments will ,provide a more competitive interest rate at this time, and it is hereby determined to be in the best public interest and convenience to so provide, in all future proceedings relating to the issuance and authorization of bonds, that the term shall be 19 years from the 2nd day of July next succeeding ten (10) months from their date. All changes as above set forth are ordered pursuant to the provisions of the "Municipal Improvement Act of 1913", and specifically Section 10352 of the Streets and Highways, and said changes are determined by said City Council to be in the best public interest and convenience of the property owners within the boundaries of the above referenced Assess- ment District. . -2-
