A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ARCADIA GRANTING CONDITIONAL'USE
PERMIT 77-25 UPON AN APPEAL FIlOM '1'111\
PLANNING COMMISSION FOR A COIN-OPEHATED
SELF-SERVICE CAR WASH AT 28 WEST LIVE OAK
AVENUE
WHEREAS, Edward E: Simpkins and Edward E. Simpkins, Jr.
have duly filed a Conditional Use Permit 77-25 for the purpose
of constructing and operating a 24-hour coin-operated self-s,ervice
car wash at 28 West Live Oak Avenue; and
WHEREAS, the Planning Commission denied the permit for
the reasons of detriment to water conservation, policing problems
of an unattended business, and traffic congestion at the inter-
section; and
WHEREAS, the applicants have duly filed an appeal fram
the decision .of the Planning Commission, and a public hearing on
the appeal has been heard; and
WHEREAS, the Planning Department has recommended approval
of CUP 77-25.
NOW" THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA
RESOLVES AS FOLLOWS:
SECTION 1. That the City Council finds:
a) That the granting of such Conditional Use permit will not be
detrimental to the public health .or welfare or injuriaus to
the praperty or improvements in such zane .or vicinity.
b) That the'use applied for at the locatian indicated is properly
one for which a Conditional Use permit is authorized,
c) That the site for the proposed use is adequate in size and
shape to accommodate said use, and all yards, spaces, walls,
fence~, parking, loading, landscaping and other features re-
quired to adjust said use with the land and uses in the
neighborhood.

d) That the site abuts streets and highways adequate in width
and pavement type to carry the kind of traffic g'enerated by
the proposed use.
e) That the granting of such Conditional Use permit will not ad-
versely affect the comprehensive general plan.
SECTION 2. That, for the foregoing reasons, the City
Council grants the appeal to operate' and construct a coin-operated
self-service car wash at 28 West Live Oak Avenue, subject to com-
pliance with all applicable regulations of the Arcadia Municipal
Code and upon ~he following conditions:
1. That there be a 'minimum 10-foot setback on Live Oak,
and said setback be landscaped.
2. That the landscape planter adjacent to the westerly
property line be a minimum of 5 feet in width.
3. That a revised plot plan and landscape and irrigation
plan be submitted to the Planning Department prior to issuance
of any building permits.
4, A 6-foot high block wall be located between the.
southerly parking area and the proposed self-service car wash,
5. That lighting shall comply with Section 9265.6.1 of the
Arcadia Municipal Code,
6. That the parkini area shall be striped and have wheel
stops in accordance with Sections 9269.8.A and 9269.9.A of
the Arcadia Municipal Code.
7, That a trash enclosure be provided as' per Section
9265,6.6,
8. That building materials be as per plans on file in
the subject case or equivalent ,material as approved by the
Planning Commission.
9. The hours of operation shall be from 7:00 a,m. to
11:00 p.m., seven days a week.
10. Sound eminating from the car wash equipment shall not

exceed 50 decibels at the southerly property line, adjacent
to the residenti~l properties in Temple City.

ll, Subject to approval of architecture by the Planning
Department,
SECTION ,3. That the City Clerk shall certify to the
adoption of this resolution.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia
held on the 20th day of December, 1977, by the affirmative vote of
at least three Council Members, to wit:
