RESOLUTION NO. 4698
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARCADIA FINDING THAT THE PUBLIC INTEREST
AND NECESSITY REQUIRE THE EXTENSION OF THIRD
AVENUE NORTHWARD TO SANTA CLARA STREET AND
ACQUISITION OF PROPERTY THEREFOR
THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY
FIND, DETERMINE, AND RESOLVE AS FOLLOWS:

SECTION 2. That the project is planned and located in
the manner which is most compatible with the greatest public
good and the least private injury, and the property described
herein is necessary for the project.
SECTION 3.' The property hereinafter described is to be
acquired for public street p'urposes, pursuant to California State
Constitution Art. I, Section 19, and California Government Code
Sections 37350.5 and 40404(a) and California Code of Civil Pr07
cedure Sections 1240.010, 1240.110 and 1240.120.
SECTION 4. That aforesaid property heretofore and herein-
after referred to as "property" is located in the City of Arcadia,
County of Los Angeles, State of California,_ and is more particu-
larly described as follows:
That portion of Lot 6 in Block 84 of the Santa Anita
Tract, in the City of Arcadia, County of Los Angeles,
State of California, as shown on map recorded in
Book 34, Pages 4l and 42 of Miscellaneous Records in
the office of the County Recorder of said County,
described as follows: .
Beginning at the intersection of the southerly line of
said Lot 6 and the easterly line of Lot 28 of Tract No.
6860 as ,shown on Map recorded in Book 78,Page 75 of.
Maps in the Office of said Recorder; thence northerly
92,6 feet along the northerly prolongation of the

easterly line of said Lot 28 to the beginning of a
tangent curve, concave southwesterly and having a
radius of l5 feet; said curve also being tangent at
its westerly terminus to a line that is parallel
with and distant southerly 10 feet from the southerly
line of the right-of-way of the Southern Pacific
Railroad Company, as described in deed from H, A.
Unruh to the San Gabriel Valley Rapid Transit Trail-
way, recorded in Book 423, Page 269 of Deeds, records
of said County; thence westerly 23.56 feet along said
curve to said parallel line; thence easterly along
said southerly line 90,00 feet to a point of cusp
with a tangent curve, concave southeasterly having a
radius of l5 feet, and a length of 23.56 feet; said
curve also being tangent at its southerly terminus to
the northerly prolongation of the westerly line of
Lot 27 of said Tract 6860; thence westerly along said
curve to said point of tangency; thence southerly along
said northerly prolongation 92,6 feet to the southerly
line of afore said Lot 6; thence westerly along said
southerly line 60 feet to the point of beginning
SECTION 5, That the City Attorney of the City of Arcadia
is hereby authorized to prepare and prosecute in the name of the
City, such proceeding or proceedings in the proper court having
jurisdiction thereof, as are necessary for such acquisition; and
to prepare and file such pleadings, documents, briefs, and other
instruments, and to make such arguments and generally to take
such action as may be necessary in his opinion to acquire for the
City fee simple title in and to said property for public use.
The City Attorney is specifically authorized to take whatever
steps or procedures available to him under the Eminent Domain Law
of the State of California contained in Title 7 of the Code of
Civil Procedure Chapters 1-12, Sections 1230,010 - l273,050,
SECTION 6, Notice has been sent by first-class mail to
each person whose name and address appears on the last equalized
county assessment roll for property, advising each person of the
intent of the City Council to adopt this resolution and the right
to appear and be heard on the matters referred to in California
Code of Civil Procedure Section 1240,030, and no person

filed a written request within 15 days after such notice was
mail~d and no person appeared and no person requested to be heard
by the City Council,
SECTION 7, The City Clerk shall certify to the adoption
of this resolution,
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the City Council of the City of Arcadia
held on the 20th day of December, 1977, by the affirmative vote
of at least four Council members, to wit:
