HomeMy WebLinkAbout4189 , .. RESOLUTION NO. 4189 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA ESTABLISHING RULES FOR ISSUANCE OF'PERMITS FOR AUTOMATIC _TELgPHONE DIALING DEVICES. ' WHEREAS, concurrent with adoption hereof; the City Council has adopted Ordinance No. 1424 prohibiting the use of automatic dialing equipment using pre-recorded messages to connect to a City telephone without a permit; and' WHEREAS, it is desirable to provide for the issuance of such permits. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE . CITY OF ARCADIA THAT: SECTION 1. The License Officer is authorized to issue a permit for the ,installation and use of an automatic telephone dialing device system which is programmed to dial and connect to unpublished telephone numbers assigned to the Police Department or Fire Department and deliver a pre-recorded message. An application for a permit shall be made on a form pre- scribed.by the License Officer. The application shall contain information which is reasonably necessary to assure that such systems shall be used only for proper police or fire purposes and to permit a proper response to such a message. The permi t'tee, in writing, shall release and hold the City harmless from any claim, injury, or damage arising out of the use of ' such device, including failure to respond, for whatever reason, to any call, made by the device. -1- 4189 , Permit fees shall be paid to the City by the holder of any such permit at times and in amounts as determined by the City Manager to be sufficient" when accumulated with other such permit fees, to pay the City's costs, from time to time, of the telephone service. Conditions may be attached to a permit which are deter~ined by the Chief of Police or the Fire Chief to be reasonably necessary to assure the proper functioning of the system and ,the City's telephones. The City Manager may revoke a permit if he determines that the holder has failed to pay any fee which is due and payable, has violated any condition of the permit, or is using the system so as , to cause an undue number of "false alarm" calls or in a manner which prevents efficient use of a City telephone by the Police Department, Fire Department, or other permittee. A revocation shall be effective upon delivery of a notice to a permittee, which notice shall state the reason for the revoca- tion. An appeal from a revocation may be made to the City Council by filing a notice of appeal with the City Clerk not later than ten days from the effective date of 'revocation.
