HomeMy WebLinkAbout4525 RESOLUTION NO. 4525 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ESTABLISHING UNDERGROUND UTILITY DISTRICT NO.7. WHEREAS, the City Council of the City of Arcadia, at its regular meeting of September 2, 1975, called for a public hearing for September 16,1975, at the hour of 7:30 o'clock p.m., in the Council Chambers in the City Hall, Arcadia, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires, and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service, within that certain area of the City described as follows: Beginning at the intersection of the west line of Holly Avenue 80 feet wide and south- easterly line of Huntington Drive, eastbound 60 feet wide; thence northerly along said westerly line to a line that is parallel with and distant northwesterly 20 feet from the northwesterly line of Huntington Drive, west- bound 80 feet wide; thence northeasterly along said parallel line and its northeasterly prolongation to the northeasterly line of Colorado Place 80 feet wide; thence south- easterly along last mentioned line and contin- uing easterly along the northerly line of Huntington Drive through its various courses and distances to the westerly line of Santa Anita Avenue 100 feet wide; thence southerly 95 feet along said westerly line; thence westerly parallel with last said northerly line to the southeasterly line of said Hunt- ington Drive eastbound; thence southwesterly along said southeasterly line and its south- westerly prolongation to the point of beginning. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and -1- 4525 WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That pursuant to Ordinance No. 1375 of the City of Arcadia, the above described area is hereby declared an underground utility district and is designated as Underground Utility District No. 7 of the City of Arcadia. SECTION 2. That the City Council does hereby fix September 1, 1976, as the date on which affected property owners must be ready to receive underground service and does hereby order the removal of all poles, overhead wires and associated overhead struc- tures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within Underground Utility District No. 7 on or before December 31, 1976. SECTION 3. That the City Council of the City of Arcadia hereby finds and determines that the public necessity, health, safety, and welfare require the removal of poles, overhead wires and associated structures, and the underground installation of wires and facilities for supplying electric, communication or similar or associated service in said area. SECTION 4. That said City Council finds and determines: A. ~'hat the undergrounding to be accomplished pursuant to this resolution will avoid or eliminate an unusually heavy concen- tration of overhead distribution facilities. B. The streets, roads, or rights-of-way in said area are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic. -2- 4525 C. The rights-of-way adjoin or pass through the Arcadia Civic Center, the Los Angeles Turf Club, the Methodist Hospital, as well as the Los Angeles County-Arcadia Park, a public recreation area, and the Arcadia Park Rose Garden which is an area of unusual scenic interest to the general public. SECTION 5. That the City Clerk, within ten (10) days after the adoption of this resolution, shall mail a copy hereof and a copy of Ordinance No. 1375 to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. The City Clerk shall certify to the adoption of the resolution.
